Is it legal? Scam at work? Cook from Hotel

Hello all working peoople.

Long story short.

I was working at hotel as cook and for personal reasons plus working conditions i had to quit this job.
So last day when im going to work to take out all my salary what i made till day i worked got bad suprise. These peoople took from me 1000 franks because i stop my contract before it ends. In contract it does not says anything like that that i must to pay them something in case i go.

I wanted to be profesional and good employee thats why i let them know before i quit. That was my biggest mistake to do things right with this boss who is piece of shit.
If i would just go and tell nothing i would not loose any money. I feel so angry to myself because i wanted to do right but it was bad at the end.

I let them know 7 days before that i want to leave

So again this boss is piece of shit because how he treets people who are working for them. Giving bad or old food for workers and customers. ( workers are paying 10-20 franks per day for food ) This piece of shit is making money even from his workers. He takes money for food but gives some old shit food to workers. Its was never fresh food.

Many times i had to give for Hotel guests old meat because its expensive. He say to me just wash it. Dont even saying about all shit in freezer what he gives to guests from freezer. Shame on this chef really.

I went there with full ambition to be succsesfull and make money but it turns out like this.

Can anyone recomend me something ?

Thank you all for attention

If you only gave 7 days notice, were you still in the probationary period (Probezeit)?

Now i looking at this contract and i think i had 1 month probezeit. But not sure bacause i dont understand Swiss or German. Is it possible to show you somehow my contract to be sure.

What do you mean? Is speaking the truth is crime ? I have questions and i want to get answers, because i told i feel scammed.

If it is a time limited contract and the contract does not mention any early cancellation option than there is no early cancellation option.

If you think the food is tainted, refuse to cock it. In addition contact the relevant authorities https://www.gef.be.ch/gef/de/index/d...sation/kl.html

It is German. But you signed something you do not understand

Take a picture. Open it in Paint. Cut out all personal details (do not use a brush), save it as .jpg, upload it here.

what you think is the truth and the owner thinks is the truth are two totally different things, right now you are slandering a business and the owner directly on a public forum. naming the hotel and the fact you were the cook make you totally identifiable.

Re: Is it legal? Scam at work? Cook from Hotel

So your employer is a scammer since he does something that you don't understand due to a contract that you don't understand? You basically have no clue what is happening but at least you know who to blame and above all that is not you. And to make it worse you decide to name and shame them in public.

Thanks, Mirfield, for taking the name of the Hotel out of the thread. That's much better.

Relevant here are points 3 and 4 and then possiby 10 and 11

3 Probezeit /trial period
4 Kündigung / ending of contract

10 Abzüge/deductions
(if it states anything else above the mandatory deductions for AHV/ALV etc, e.g. perhaps it states a fine if the employee leaves the job without proper notification etc)

11 Vereinbarungen nach Arbeitsgesetz, might also contain some more info in regards to your problem

Even if nothing about such is mentioned in the contract, if OP breaches the contract law allows for extra costs due to this to be claimed at him. So lets say he should have given notice a month upfront, and has to be replaced by somebody from an agency, than the price difference between the agency and him during a certain period could very well be a price he has to pay.

However simply redrawing a 1.000,- from his pay check without proper specification and all such is also not how any of this works.

If you show us your contract (fully anonymize it tho) we're not to lazy to help you some in this, and without your contract we can't give you answers.

https://compressimage.toolur.com. (just one of many sites who do such)

Crop the quality/format to make the file size smaller.

Or use an imagehoster that allows for much bigger sizes than this site:

https://imgbb.com for example.
