Online shopping mockery: Cal*******

I have been working for ecommerce companies since 10+ years and of course shopping online since forever, and this is the first time I'm experiencing such a ridiculous transaction. Here is the story.

September, 10th: I ordered beachwear from the famous Italian fast fashion brand Cal******* (is there such a thing as defamation law here? I'm not sure so let's not mention.) The package was supposed to be delivered to Uzwil Post office (pick up from the post offices was an option THEY provided and I didn't even type in the address.)

September, 11th: They mailed and said half of the items in my order were not available anymore. Bummers, but okay I didn't mind it.

September 13th: I checked the tracking code, turns out they delivered my package to Sirnach 24/7 parcel pick up point. WTF is Sirnach? I don't even know where Sirnach is plus I had a flight and I did not plan to go to Sirnach. As their support does not speak English, I asked a German speaking colleague to help me, but the customer service sounded like a 3 year old giving random responses and testing the adult patience limits. She kept telling us yes the package is in Sirnach. YES WE ALSO SEE THAT, BUT WHY? No response. I have emailed them the chat transcription and asked them to resend my package to Uzwil. They said it was not possible, but as I won't pick the package from Sirnach in 7 days, it will be returned to them and they will refund me.

November, 28th: Guess who didn't received a refund? I waited two Credit card statements (because the initial charge was in October statement, I thought the refund may show up on November) I reached out again, asked for a refund, they said we don't know where the package is we have to find it.

December 5th: I received a mail, instead of a refund they said "we found your package, it's in Basel! Go pick it up until December 6th." I'm not anyone's butler, I work on weekdays like the majority of the adult world population and I don't live in Basel either. Basel is 2,5 hours away from the address I requested. And on top, I requested a refund, not a random new pick up location.

December 6th: I asked German speaking Swiss husband to call them. They had a nice chat like nothing ridiculous ever happened (ughh the neutral Swiss) and then they promised to look into it. Because again they didn't know where the damn package is.

December 18th: Guess who never heard from them again?


I really am super angry, and I'm very well seasoned in complaining usually. If this was in Turkey I'd write it on twitter and people would drag them for days. If this was in Dubai I'd call the Economic Department and they would make them refund, gift, apologize and feel really really sorry. If I was in China I'd rate them bad, it would hurt and Alibaba would refund me. Here I came to the forum to check similar posts, realized consumer rights is a joke here, and now I don't know what to do. I paid for things I have never received, I have been ridiculed, and I can't even get a response. What should I do?

You should have reversed the payment via your credit card company and shop and C&A in future...

They can, but they shouldn't be surprised when they are treated according to how they comport themselves (and that includes how they dress).

If the online company from whom you've ordered is legally domiciled in Switzerland,
then do not phone them again, and do not write them any further mails. Instead, switch to a paper letter sent in an envelope, registered at the Post Office. In Switzerland, that's the proper way to settle matters formally.

As proof of receipt, retain a copy of the letter sent, and the receipt for the registration that you receive at the Post Office counter. As these sometimes use poor quality printing, make a photocopy of the the receipt before it fades.

Here's a recommendation of what the letter should say:
Good Day

On DATE I ordered Item 1, Item 2, Item 3. (Tip: use the exact product names and numbers as on their website).

On DATE I receive a mail to say that Item 3 was no longer available, but that Item 1 and Item 2 would be sent to me.

When the parcel did not arrive, and after several mails and phonecalls, on DATE I received a mail (or was told on the phone) that I would receive a full refund in the amount of Fr. 9999.

I have not received any parcel from you, and I have also not received any refund from you.

Please ensure that the refund of Fr. 9999 is paid into my bank account Number .... (or refunded to the same credit card account I used to pay, namely....Number) by DATE (10 days from today). After the refund transaction has been made, please then confirm, in writing, that this matter is settled and that I will not be billed any further sums, so I can close my file.

Thank you.
I strongly recommend that you do not send this letter in English, but translated into the local language in which you have been dealing with the company.

If the online company from whom you've ordered is outside of Switzerland,
I doubt that there is very much you can do, or at least, that the costs of taking this issue up will be very high.

OP, you should have called Post Sirnach and tell them to send it to pickpost Uzwil. Short ways and stuff?
You could now call Basel and do the same .... if the parcelis still there.

Well they said the package cannot be rerouted the first time and I trusted them. Now I realize probably that was wrong as you said. Then the second time I was already asking for a refund at that point, instead of refunding they sent it to Basel technically I cannot return it anymore as it was ordered a long time ago, better if they figure it out. So I’ll follow the advice and send a written request, thanks.

You can always cancel the credit card charge claiming you never received the goods. You have 30 days typically from the date of invoice but check the T&Cs of your card.

I always do this process immediately if matter not resolved within 2 weeks just as a precaution - the OP lost 6 weeks and waited 2 credit card statements after it was confirmed they would refund. Next time better check online or phone your credit card company in case you are still only on paper bills with no way to check in between.

I would have written then and said "You have confirmed you will refund me. Kindly do so by (INSERT REASONABLE DATE). If reimbursement is not received by then, I will proceed with credit card charge reversal." and then done that.

OP: one to learn from it seems. You can always write to their public Facebook page and hope a bit of shaming will get someone to help you.

Uzwil centre - Sirnach centre

16KM / 12 minutes with car, both are on the highway with only one exit in between.

How on earth do you need 35 minutes?

Harassment is a big word, but being judged on appearance is a very normal thing, and being treated differently due to different judgements is also very normal.

I have long hair, wore metal clothings in the past and could have tremendous hang-overs after a concert, on one of those mornings I went to a bike store and had 4K to burn on a bike, store simply refused to let me have a test-ride, and kept pulling me towards 2nd handed citybikes. On the other hand I also have friends who were jobless bums, but they twice hired decent costumes, put on a nice smell and went by car dealers to have free fun rides in Audi's and Mercedeses.

Appearances matter, always have and always will.

I am with OP on this one. Even assuming OP had a car, like you obviously are doing, if you order something to a specific place offered by seller, you don't want to waste time and money retrieving it somewhere else.
