Where we can go to complain speilgruppe

My daughter was in speilgruppe last year and the first week she has an accident over there, she was so painful and full of blood on the face when she back home. After we have to stop one week, the second she go there she was still hurted in speilgruppe and they don’t care at all. Now the problem is we will not go there any more and the speilgruppe don’t let us stop and ask us to pay all the year even if it is their fault. We alive in a village in Kanton Zürich and we already report to Geiminder, but it doesn’t work because speilgruppe is private behavior, they tell me that they are not responsible for the private speilgruppe even it is inside the same public Kita. So I would like to understand where should we go to complain this speilgruppe? Anybody have ideas or suggestions? Many thanks.
We already submit the request to stop in November 2019, but they say the contract is not possible to stop whatever make us unbelievable, shall we have to pay all the year even it is their fault and even we already inform them in advance we want to stop? I check the condition to stop but they didn’t write anything on their website.

Check the contract but most places stipulate 3 months' notice.

Did they write an accident report for the two incidents? Granted it's probably not grounds for leaving a play group because kids do bump and knock themselves even when they are under strict supervision. Were they negligent in any way?

It is Spielgruppe, and Gemeinde.

I would cancel immediately based on Art. 404 Abs 1 Code of Obligations https://www.admin.ch/opc/en/classifi...ndex.html#a404 claiming a "zerrütetes Vertrauensverhältnis" (shattered mutual trust). Sent it by registered post, no longer pay anzthing, wait and see.

PS: A "request to stop"? Simply send a firm and clear cancellation.

Thank you very much. We already submit once in November and they didn’t accept, now we have this rules we will send again to them by post.

You have to cancel based on proper grounds. Just sending a letter like we quit/we would like to quit is not doing the legal trick.

Do as aSwiss said and cancel based on the article and use registered mail and keep a copy of the letter yourself. The longer you wait, the more you might have to pay.

A cancellation does not have to be "accepted". If you think you are in the right you simply no longer pay and see what happens. Sure, if there is a disagreement it might end with pursuit/Betreibung and court.

I do not know what you have written in November. Depending on that it might have been clear it was a cancellation due to shattered mutual trust and now all you do is to reaffirm your stance backed by the law.

Or it might be that you did not properly cancel and you will have to do it right this time. This might be the case if you have already, unconditionally, paid for Nov, Dec, and Jan.
