[Rant] Speeding fined for overtaking ebike...

I really think I was set up...

At the outskirts of the village, I went to overtake an ebike on a straight stretch of road. I did accelerate and I did have to go faster than the speed limit to safely overtake without spending too much time in the opposite lane.

But just at that point a black temporary speed camera flashed on the side of the road I was overtaking.

Today the bill arrived and I am not happy, and I actually think the police install the camera there for an hour or so (It had gone when I got back two hours later) and send someone on an ebike up and down at 45km.. good little earner that is.

I mean who is cycling over mountains in Feb? (which is where the road I was on was going)

It may be unfair, but regrettably its the law and you were speeding. There are no mitigating circumstances here I'm afraid. Pay up and forget it.

The police are now putting up more and more of these temporary cameras, and indeed, they may be up for just an hour or two and then they get moved. It's more effective than the fixed ones, since most locals know where those are

I know, I know.. had it been 40 francs I would not even bother bothering EF today.. but seems this was a particularly accurate (dare I say Swiss) speed camera, with little leeway.. and I was judged 1 Km into the next price band.

I shall not be lunching today... in protest!

Nothing you can do, but stay behind the bike or overtake within the speed limit. 7 or 8 years ago I had to drive up Rosengartenstrasse in Zürich at 10 one night during heavy snow fall. Even buses were spinning wheels trying to get up. So I put on a spurt to get over the steep climb. I got flashed, I explained why I had to go a bit faster (it was only a 40.00 fine so not crazy fast) but of course mine was no excuse and I had to pay.

It sounds like a reckless overtake (dépassement téméraire). Lucky for you, the evidence only points to normal speeding.

You never know when bad luck saves your from worse luck.

There are two legal types of E-Bikes:

Standard E-Bike: The motor is only allowed to support up until 25km/h, then it cuts out..riding faster is either gravity or 100% at rider's power input. These are categorised like normal bikes (no helmet necessary, no registration, no licence).

E-Pedelec: Classed as a moped, with motor support up to 45km/h. These need to display a licence plate, have insurance, and the rider must be a licence holder with a helmet and rear view mirror. Can also go faster with gravity or 100% rider input.

And one illegal type:

Tuned bikes: Standard E-Bikes with the limiter removed. Highly illegal, if you get caught you will be fined heavily, if you have an accident you won't be insured. New generation Bosch motors cannot be tuned.

As both a motorist and a cyclist, I am constantly surprised why motorists feel a necessity to overtake cyclists no matter what. I have had several occasions where motorists have sped up to overtake me, only to cut me off on a right turn or stop at long-standing red light a short distance ahead.

Just on the weekend I was cycling on a country road, when I signalled and moved to the centre line to turn left. A split second before commiting to the turn I was barely missed by a car that overtook on the left...scared the daylights out of me.

I suggest more two way respect between these modes of transport, as in the Netherlands.

Why would you move to the centre line if you want to go to the right?

Heck if you signal right and than move to the centre even I with hundreds of thousands of km's in the Netherlands without hitting cyclists could have hit you.

I don't find it remotely unfair. He was speeding and apparently too impatient to wait for a short while behind a bike going at almost the legal limit.

exactly the same happened to me the other day - first time I got done for 200.- and like you, for just 1 km extra. C'est la vie...

Indeed. Not sorry for OP. If you're driving a car, you should always remember you're the "stronger" person vs. bikes, velos, pedestrians, and drive accordingly, ie careful.

If there is a fast ebike that goes 45km/h in front of you, you'd have gained a whooping 5km/h by overtaking but still driving according to the limits. Even a mid-sized village rarely is longer than 2km long on 50km/h signalement. Now my school days are a bit dated, but the different in between 2km at 45km/h and 2km at 50km/h is rather small, about 3min vs. 2min 45sec (rounded) - so to gain 15sec, you took a risk that clearly wasn't worth it.

I totally understand drivers that get angry if someone blocks the left lane on the highway doing 90km/h in a 120km/h zone, but if the difference between allowed speed and driven speed is 5km/h, you really need to calm your nerves and chill for a few minutes behind the slower vehicle, and wait for a legal/sane opportunity to overtake it.

Great theory Try it in France... I regularly get overtaken in towns while doing 50 in a 50 zone with a solid white line down the centre.
