Neighbor problem

Hi guys

So my upstairs neighbors, two men, are getting on my nerves. The balcony is made out of wood and we got the informal moving in that we cannot wash or use water because it drains. They have a lot of plants and there is always water making a mess, they should use something to drain but that looks like a f* forest i guess is easy to overwater, we cannot even use the balcony, we just have the recycling and some chairs. The water comes brown and we complained several times, in the beginning nicely and they were polite. But it keeps happening at night.
We wake up and everything is stained. I complained to the renting firm they said that they sent a letter. Kept complaining because there is nothing we can do politely anymore but they tell me to call. With all the photos and complaints it should be done by now!
Now I came from holidays and disgusts me going outside. Help me!

If this could be considered a defect you could threaten to deposit the rent at the conciliation office until the situation is resolved (i.e. less rent, limiting number of allowed plants on balconies, etc.).
Be sure you are not exxagerating, some dirt can be wiped off quickly from a plastic table before dinner, it looks like they are making at least the effort to only do it at night...
Another option is to spray some glyphosate from below and kill everything, that would be fun in the ensuing legal battle.

Not got an answer to your problem, but I have an issue kind of in the same vein. I need to clean my balcony floor and walls as they are covered in bird and bat poop. I've brushed it but really think it needs a jet wash or something. Not sure how to do this without really pissing off the neighbours below

Is the balcon protected from the Rain? wouldn't it be easier to build a simple drainage system?

The balcony is not protected. If it rains it needs to be a lot of rent because the sides are well covered. It is simply because the balcony does not have good drainage but like i said he has a lot of plants. I would never use chemicals i have a cat. Poor kitty has all her toys destroyed Outside from the water. Also we do not want to keep complaining to them. I feel like they do this on purpose because they do it at night, but if I put up a scene others may think i am homophobic or something. I am super chill. I am mostly upset with the firm. I pay rent so the house should be usuble.
Also what is a conciliation office?

You could just go downstairs and tell your neighbours that you need to clean properly, and don't want to risk dirtying their things. Ask them if they would like to please move/cover/protect whatever they have on their balcony, so that it doesn't get dirty when you swash water on yours. They'll most likely think you're really considerate. Agree on the day. And then you can get on with your task without fearing that you'll upset them.

Wait for a heavy rain, and then wash it during the storm.

I wouldn't be surprised if the real estate company ignores the complaints now but asks you to clean your balcony and leave it perfect when you want to leave. It would be good to clarify with the firm that you're not liable for the stains or water damage to the wood in your balcony, otherwise your deposit is compromised.

Is there another balcony below you? An sleazy approach to the issue would be to let water run in your balcony at the same time your neighbors above water their plants and bring your neighbor below into the discussion. Bit immoral, but water is not a dangerous chemical and 2 (or 3?) neighbors complaining is better than just 1.

This should not be happening to you and is unacceptable behavior from the people above.

It's important you keep copies of all your letters and all photographic evidence which should be taken every day. Also make a note of the date, time and notes of any verbal communications you have either with the tenants or the agents.

Estimate the cost of the inconvenience to you and any damage caused, and inform the agent by registered letter that if this does not stop you'll pay the rent less the disputed amount which you'll deposit with the reconciliation service in your town. Do not exaggerate the amount, I'd think CHF 300 a month would be reasonable.

You will then be called to a hearing with all the parties summoned where the judge will attempt to reconcile the parties. Hopefully it will not come to that and steps will be taken to prevent the water coming through.

Alternatively, one can hire a cleaning company to do this job and they'll (most probably) make a lot less mess and talk to the neighbours downstairs in advance....(been there done that)

We have the same problem with our neighbor upstairs with her window plants. I clean the windows, she waters her flowers & then I have muddy spotty windows. Super annoying! I've left a few notes as she forgets from time to time.

Same problem here. If we keep our windows open during hot days, the water will sometimes splash into kitchen.

We've already sent them 6 letters about noise, which have ended up being ripped apart and slided in under door. Though they have taken noise down a lot, they still water their plants every week..
