Well...it IS a cause for some people to complain, otherwise we wouldn't see so many similar stories here on EF. Whether it's a legitimate cause for complaint to a landlord or similar? Definitely not!

It seems bored/nosy/crazy neighbors are common and they try it on with new residents just to see if it works.

If the fan wasn't loud enough to bother your neighbor's sleep, I doubt that he or she would complain about it. Something could be wrong with the fan and your neighbor could be a light sleeper. I can hear the clothes dryer of the people who live below us.

Like others have suggested, call the landlord and have them check it out. And until the problem is solved that way, I suggest getting some kind of battery operated light for inside the bathroom, to use at night. Something like this:

Though of course, that's not nearly as sexy as the thought of someone wearing a head torch while taking a poo.

Now I don't want to make this post a bit 'too personal' - but how many get up in the middle of the night for a poo? Once in a blue moon perhaps? So quick piddle and back to bed- no need for flushing 99.9 of the time.

But at the end of the day, or in the middle of the night, rather- if it upsets your neighbour, even if you don't 'get it' - why not find a cheap and easy solution as suggested above, to use another light and not trigger the ventilation. At our flat in the UK, we can also manuall disactivate the fan at night if we wish. Do you not have a switch somewhere you could disactivate at night when you go to bed? Why live in conflict if it is easy and cheap to avoid?

Oh my, and Tom groans - again, lol.

Urine sitting over-night isn't a nice thing to wake up to, I guess I'd sacrifice this for somebody in the appartment...but a neighbor who bosses OP around and announces "no noise after 22.00" over something that the OP cannot influence much, doesn't seem worth that kind of sacrifice.

We had some bully tenants in our last building that thought they ran the place & complained about anything & everything.

This “fan” is something they complained about to my upstairs neighbor. The neighbor ended up having the landlord replace it. They continued over the years to torture our patient neighbor. When they once complained to us about the unsightly air condition hose we used during the summer, we made it quite clear we wouldn’t put up with their nonsense and they were extra nice to us in the future.

OP, you’ve done nothing wrong. Don’t give in to this behavior as it will set a precedent. Since it is not your fault, let her complain to the landlord. My guess is she won’t have the guts to do so. Best wishes, don’t stress!

It took me until the 2nd page but I am relieved to see replies pointing out the unreasonableness of the complaint. I am amazed that so many replies suggested workarounds to keep the fan from operating. How loud is this the fan that it causes complaints from the upstairs neighbour? People are allowed to use the toilet, blow their noses and fart in their apartments without their neighbours complaining. I would tell the neighbour to find a detached house if they are so sensitive to noise.

Flushing the toilet at night constitutes normal use of the apartment and cannot be prohibited by Nachtruhe. Everyone is different. If the OP needs a light when visiting the toilet, then they need a light on.

In the OP’s situation, I would inform the building manager that they need to check the fan, and tell the Bünzli upstairs that OP can do nothing more until the owners get the fan sorted.

I do. Some friends used to get "Go back to your country, brutes from the Balkans" post-it notes. On their door.

Until the bought their own apartment.

The funny thing is they were never at home, working full time and travelling a lot.
