Cablecom Help!

Hi All,
I am just reposting it to the right forum...

I have been checking this site regularly but this is my first post. I am in a trivial situation, in which I would want to know your opinions and suggestions. In Dec 2005, Even though I did not register to cablecom, I got a parcel from them and I accepted from the post office as I don't know where it come from. Soon, I sent them emails about this issue and told them to cancel this and let me know the address to which I have to send the kit. They sent me back mail to say that I have to send a written and signed letter to them (weird as I did no signature on any paper, but still got the kit...). So I did. They courteously told me that the cancellation is accepted but I have to pay for one year as the minimum contract is one year. I called them and tried to explain them and couldn't get a proper response. I was just getting bills but I didnt want to pay them, as I had never ever connected thru the cablecom network (Funnily, I had another internet from my apartment owner for the whole apartmen ..which is thru the phone line). Also mine is a furnished apartment and I dont have a contract with my owner, as I knew him thru one of my friend. So I don't pay for the cable and is not in my name...
Later cablecom passed on this issue to a debt collector agency, I still didn't know what to do.. Sent them mail asking for the copy of my signe contract, they never came back on that, And I sent back the cablecom kit to the person I was corresponding in Cablecom (As I didn't know the logistics department address). Even after doing all this, I had no solution and now I was getting my bills from the debt collector agency with all the added amount.
Recently, I got a letter from the office de la pursuites. I sent back the letter saying I oppose to pay. I am sure this issue is getting bad to worse each time and I am not able to solve it. I just want to finish this issue.
What can I do in this situation, what is the best step to take? I have a L permit and I also want to know if this would affect my extension of the permit.

1) split your text into paragraphs
2) search for Betreibung on this forum, it may give some background
3) it sounds immensely strange, and fightable but the details of the parcel getting send without reason need to be verified; by which I mean does anyone here know this Cablecom behaviour?

Point noted...

After searching the forums, I see that they are all for the ones for which actually they have to pay the bills, but not like in my case...

As for the extension of the permit, having a name in the register of Betreibung looks it may affect it..But what exactly is a Betreibung ...What can I do to fix this asap, Please let me know.


By the way... Not sure why I am unable to post messages thru Mozilla...

The registration in the Betreibung has little effect on the renewal of permit. If it did then nasty people could simply post a betreibung for any foreigner they did not like. Successful cost recovery exercises are a different matter ie if they decide against you.

Anyway some important information. This whole situation is not something that has started today. ie it has gone on for some time. Important is the following.

When did it start and with whom did you have contact.
When were all subsequent contacts and how
Which are the debt recovery agency.

Without this information nobody here or elsewhere can help you...

Relieved to know the info abt Betreibung, But i am not sure what exactly it is....

It started in Dec 2005, I had contacted many times the Cablecom, and later on I sent communications to both cablecom and the debt collector agency. All the contacts were thru postal letters and some of them were registered letters(letter recomande). The debt collector agency is Intrum Justitia.

Okay Intrum Justitia, I have had my run ins with them in the past
Understand the following you will need to play cool - I assume HOPE you have rejected the betreibung and chosen to take a civil court appearance.
If so reply to every letter they send via registered mail to the address they provide you. It will be easier to try and fax them as I guess they are still sending out mails with non-existent Fax numbers and telephone numbers.
And then wait. IF you have never had any contact with Cablecom except to cancel the contract they have sent you then you have nothing to worry about. I would also suggest contacting the CFO of Cablecom and sending him a bill - explaining the situation in English/ French or German. Your bank will give you a payment slip for free (pack of 20 or so) so you can send it. Under cablecom rules any bills must go through their purchasing department. Here you can list all the communication etc you have had through registered mail plus the time @ SFr. 90 pro Stunde etc. Furthermore I would give them a few weeks to pay ie a deadline and ask them for a confirmation that they accept the bill. Send it registered.

Yes, I have rejected/opposed to the "command to pay" [English translation of "Commandement de payer" in French], I didn't know I have chosen to take a civil court appearance .. :-|

Ok so this is a kind of a plan which will work out if still Intrum Justitia are sending letters with incorrect fax and telephone #, I will get those letters and try to check them out tomorrow if those # work.

Well, I have had contact with cablecom many times regarding even after their confirmation of the contract cancellation. And they gave me no better response. As I had mentioned, I have already sent few letters to intrum justitia and they have replied back with the same bills stating that "since the client has provided you all the accessories necessary for the connection, you are required to pay!"

So the next best thing to do is to wait until I get the future registered mails from intrum justitia and reply to them...

By the way, I called to the federal office of consumer affairs and spoke with them on the phone and they told they will call me by tomorrow to give me more info on this....
