Finally got caught on the train 80CHF fine

A bit annoyed at myself - I had a ticket but accidentally sat in the 1st class. I realised just as the train started to move and I got up to move to a 2nd class area but the inspector came and fined me as I was already in the 1st class area.

He gave me a ticket and pointed out a phone number to call but I couldn't make out whether he was saying I could call to get an explanation of the fine or should call to explain the situation with a view to getting a reduction. Anyone had experience of this and whether it is worth trying to get a reduction?

I was actually wondering if I would have been better off not getting a ticket at all since this would have offset the 80CHF fine? Maybe lost_inbroad is onto something after all?

Accidently sat in first class? It really is quite obvious.

Could you not have just told the inspector that you where going for a walk?

Same thing happened to me, I had my 2nd class monthly but was in the first class without realising it (it was an unusually crappy train that day, and the first class was the same standard as the normal second class). I then started buying first class tickets out of annoyance.

A little clarification: Were you obviously sitting in the section when caught (just stood up or whatever), or were you essentially caught 'Walking through' 1st class.

I 'walk through' first class fairly often, and would not be pleased if I got nabbed for this.

I know someone who had a similar situation. he called the number and got the fine reduced by half. his reason was, he had paid SOMETHING, whereas if he had simply not got a ticket, then the fine would also be 80.

Also mention that its your first offense (if thats the case)

If you feel you were treated unfairly then you should call that number, or go to the customer service desk at a major station and explain the situation. Sometimes if you put your case convincingly the fine is reduced. A co-worker of mine got fined 80 Franks but after he was able to convince them that it was an honest mistake they reduced his fine to 30 Franks.

actually, it wasn't obvious at all. i only noticed when i saw the blue '1' on the wall. the arrangement/seats were the same as the 2nd class ones - except the headrest had a white cloth on it. although i had a few beers that night which may have contributed to my lack of perspicacity.

i was running for the train and took the first train door which was held open by two of the inspectors. i took the first seat on the bottom level and so when i stood up to get out, i was only a couple of meters from the entrance area, but of course, the inspectors were there as it was the first carriage to be checked.

..I can start offering courses (if desired) on how to successfully dodge fares...I'll be discussing topics such as timetables, the psychology of a conductor and also a brief history of public transportation.

They can and do get you for this, depending on the mood of the inspector. Technically you're in first class regardless of whether you're sitting, standing, or walking. I must say I'd be a bit miffed if I accidentally boarded a first class carriage, and got nabbed trying to correct my mistake.

I've lived here for 5+ years and NEVER GOT A FINE (*until.....), despite the fact that I did break the rules (unwittingly) a lot at the beginning. Howvere in the last 2 years or so I made sure to always get the apropriate ticket...and *I got my first ticket about a year ago for thinking that my gleis 7 counted on the Sihl-tal bahn (s4). It doesn't. I got my second fine fair and square a couple months ago, for that one illegal ride between my monthly netz-pass and my yearly netz-pass. That one was 120 CHF. Then, about 3 weeks ago, I forgot my wallet at work and had to go to a course out in Wetzikon. I figured because my pass is personal, if I get caught they can give me a ticket and when I go show it at a SBB counter I can pay 5 bucks and avoid a fine. I've done this, it workds. So on the way to Wetzikon I bought a ticket with 4 extra zones on it (since my netzpass only covers zone 10) then on the way home I didn't do that because I have a gleis 7 and it was about 9pm. HOWEVER the gleis 7 doesnt count i this case either, despite the fact that its on the SAME CARD AS THE 1/2 tax which does count as personal. THeres no reason that it doesnt count, after all, I paid for it, and if I had it on me it would count, and since it has my name and photo on it really only I can be using it just like the 1/2 tax. On top of that gleis 7 is for people under 26, so in creating this loophole, they are cleaning out the pockets of a demographic made up of mostly students.

I was so upset when the SBB guy wanted to give me a ticket of 150 for a mistake I made. I honestly thought I'd done the right thing, I paid for eveyrthing I thought I needed to pay for, and here this man was telling me that it was my 3rd strike and on top of the 150 fine it would be registered on my criminal record.

I think it's perfectly justified.

After all, the odour of poverty does tend to linger, even after the offender has moved to the appropriate carriage.

I believe the option of paying the difference is only available on longer train rides such as IC or IR....

That's pretty lucky, I would do 1st class all the time if the only issue was to pay the difference if I was caught.

I have to admit, I've been fairly lucky myself. I think I've been in 3-4 situations with a non-valid ticket, and a polite mix of english and swiss-german has gotten me out of paying any fine at all. It could have gone either way though.

I think its the difference of wheteher you're on an IC or IR as opposed to on an s-bahn.

On an IC or IR you can still pay the difference. On an S-bahn you get fined.

EDIT: which is what a whole bunch of people said while I was writing that......

Sounds like you were just unlucky. I would try to get it straightened out because not only do you have to pay the fine but your details are now on record and if it should happen again it's going to be an even higher fine. Tell them the facts as you wrote them here; you were in a rush, inspectors held the door open for you, you got up and attempted to move as soon as you realised your mistake but it was just too late. The fact you had a valid ticket, albeit for second class, would probably add weight to your argument. Good luck, though.
