Regarding the salary on L Permit for 12 months

Can anybody please let me know whether there is any rule of Swiss that if foreign employees from non EU countries are sent for a period of upto 12 months on L permit, they can not be offered salary in Switzerland? Actually my company is saying that because of such a law they would not be able to pay me and my colleagues salary in switzerland and is paying us the allowances just sufficient enough to bear our daily expenses. It would be great if you can confirm that if a person is on L Permit and is here for 12 months whether he is not entitled for the salary? And if the company is cheating us, I would like to know where can we raise a complaint regarding such an exploitation of the foreign employees in switzerland?

Thanks for the response... would appreciate if you could also let me know the way to bring this thing to the notice of the relevant authorities in Switzerland so that they can intervene and take some action in this regard?

I don't think there is any such law...me also on a 12 month L permit which will be renewed shortly...but i m getting regular salary....infact there are guys who are on 3-4 month permit and they also get their salary...

i would suggest to ask your HR quote this specific law....i don't know where to complain but i think there would be a lot of EF members who can help out on this...

find out if there is any sort of agreement with your company in India and teh swiss company regading paying only an allowance..

I know this from anther copany in Baden where they bring in their employees from India and aonly pay the daily allowance.. but this is an agreement between the company in Baden and the one in India...they call it "trainning"

the authorities won't care
the company won't care
the client (engagement) won't care
I assume they will also pay you back home on top of this living expense? Think about tax, you're effectively going to be evading it.

Never heard of the above. Am non EU, receiving L permit, and have full salary plus insurances covered.

FYI, as of June 2008, all L permits will be flipped to 5 year B permits.

I think you might be getting snowballed, as for complaint filing, I am not sure where to point you.

I'm not so sure.

Firstly, there is not such law. The applicable law would appear to be the requirement to pay tax in Switzerland if you stay more than 90 or 180 days dependant on the circumstances.

Obviously the point is that the requirement to pay at a level equating to local rates is being circumvented by this method. This enables unfair competition with Switzerland based companies. For our staff staying longer than 6 months in a year we are obliged to move them to a Switzerland based payroll so the method described appears, to me, to be an exploitation of a loophole that is unhealthy for the Swiss economy.


Priyank, presumably the company is paying AHV - you have an AHV number? If not then you could try registering for an AHV number and wait for the flak to start flying (if they can be arsed).

You could also try complaining to your Kanton labour office (Kantonales Arbeitsamt).

Either of the above could carry risk to your status in Switzerland, though, and are you willing to take on your company?

Backing up Lob: untrue.

The quotas for EU permits are abolished on 1 Jun 2007.
So those of us on "L"s who should have got a "B" will get it next renewal.

Per my relocation agency, Primacy. They are handling all of the work/residence permits for me as well as my visa.

I assume the B permit issue (where quota has been reached) only applies to non EU. I can double check on this. I remember in April, when we started the process, my HR rep (who works alongside the relo company) seemed to have thought that I was EU. When I reminded her that I am not, she replies "s---" in a cute, yet, oh-boy-this-is-another-process-sigh kind of way.

Groan removed - not your fault then. But do chase it up as there is nothing available in officialdom covering this claim.
