I've spoken to my daughter and here are some facts. The parents were resident in Germany for 20 years, after arriving there as refugees 20.5 years ago. Their daughter was born in Germany, and is a German citizen. Six months ago, the German authorities decided that the parents must go back to Kosovo. The parents then fled to Switzerland, and immediately applied for asylum. The asylum claim has been denied, hence the deportation. The Gemeinderat voted last night, so early this morning, the police went round and took the family to the police in Germany.

At no point have the parents committed any criminal act, or broken any immigration laws. They have done everything correctly and by the book, and had job offers subject to asylum being granted.

They should have let the family be. The kid's already settled, the authorities should take this into account rather than just looking at the letter of the law. My heart goes out to the girl, it's crap.

Just a technicality: The Gemeinderat cannot vote on granting asylum, the competent authority is the federal office of migration (art. 6a of the federal law on asylum).

Thank God!

Just imagine how unfair this would be, if your chances of getting asylum would depend on the composition of a local council...

Personally, I often disagree with some oth the decisions made by the federal office (as probably in this case). But at least that assures a bit of due process.

Perhaps they arrived in DE as asylum claimants, rather than as recognised refugees. Like CH, DE also has conditional permits, one of which is that should the conditions of the sending country improve, then the claim for asylum must fail during this period. However, were they granted conventions Refugee 1951 status ( a B permit in CH or equivalent in DE ), that would be a bar against deportation, unless the security of the new host nation is at risk ( CH / DE ).

Perhaps they had Duldung status in DE and once if expired, they left for CH and applied for recognition. CH cannot granted Refugee Status as it would go against a EU and co-signatory of the Refugee Convention's first instance findings as well as against Dublin II rules. CH has to send them back to De per Dublin II unless there is a safe and sound finding that DE has persecuted them ( very unlikely for EU countries ).

I have seen an Afghani family of 5 subject to deportation in ZH after all avenues have been exhausted. I mean - N permit as an aslyee, rejection by BfM, turn down by the Appeals Courts, turned down by ZH Canton and finally had their permits withdrawn ( N ). They turned down an offer of repatriation of CHF3,200 for each member. All this took 3.5 years having entered from Chiasso.

The day the authorities came early that morning, it was as if hell broke loose. I took pictures but had my camera confiscated for the day, it being returned eventually. Stern but anxiously looking policemen in plain clothes came around in two vans.

The father had fled to another place, and the authorities had a plane waiting in Kloten. Daughters screaming and neighbours shouting ( this was before 7am ). At the airport, the family's lawyer served an injunction like document on the Cantonal Police officials. The Canton re-examined their cause and requested the BfM to grant a provisional status ( F permit subject to sending country's conditions ) which they ultimately received. This family was rather fortunate as they had resources - money for the lawyers and contacts with organisations such as Augenauf.

I can emphatise with you having lost someone close ( as I did with many good buddies now in Senegal, Gambia etc. ) but bear in mind kids are resilient and adults know that the countries have strict rules to adhere to, and that return as a migrant remains a possibility. Naturally, all this is easier said than done.

It would seem they did not have Duldung status, as the father did have a job in Germany. Obviously the full facts won't be discovered on this forum. I'm sure the Swiss authorities acted entirely lawfully, and possibly even fairly.

I can guarantee you that they almost always do, and try to have a soft approach to those in need - hence a lot of extended N and F permits as opposed to true blue Refugees in need who get the coveted B permit. The Swiss are more inclined to give out subsidiary protection than eg DE would ( possibly related thread: B permit mit erwerbstatigkeit ,Political or Humanitarian? )

They ( the BfM ) can and do throw the book when they smell the brown stuff as a wrongful grant is a terrible deed internationally.

The difference between the local council and the federal government is that you see how silly the local council is because they can't hide it from you. Because federal governement has more layers of PR smoke and mirrors between them and you you somehow assume they must have more sense. Politicians are politicians, no matter where they sit.

It is a terrible situation. And I am proud to think that in my country (I know, bla bla bla, my country is this, or that, but hey!) something like that will go out right away into the news, people will stand up to protest and make a lot of noise to support the family. And it works!

When the governement seems incapable to see real life, real family and how much its decision destroy them as human and as unit, the population step in as a whole and demand compassion and rights for those families.

20 years in a country, you may not have the passport but it gives you a bloody good right to stay in there especially if you have been a part of the society, contribute with your taxes and schools, etc.

It's sad that a German citizen, born free, has had her family snatched in the middle of the night, and will be spending her first night in, effectively, a prison. In her own country.
