Thanks to Schengen, the Swiss had no choice in the matter. If the Germans decide they had to go back, the Swiss have to accept that.

It does seem likely that this is the case, sadly. When you think about some of the morons who are let into the country. Schengen has it's good points, but it certainly isn't all good.

Absorption of aliens was formerly practised in eg Australia but nowadays most countries do not practice it any more inline with the growing trend of hardening.

CH on the other hand, does allow a very slim chance to remain IF the conditions are met ( 4.5 years if married and with kids or 9 years minimum if single - taxes, employed / economically independent, language / integration, not a security threat and with a clean sheet ). Therefore one would easily find many people only now with a Swiss pass, but having spent their years from 1991/3 onwards in CH struggling, having come originally from East Europe and Sri Lanka - tough but possible.

I really hate 'zero tolerance' legislation, as it leaves your hands tied, and denies your sovereignty.

I'm getting a bit confused. Is the little girl 'the german citizen'? Does that mean she has a german passport? If so, the family has a good case and can apply for a german residence permit based on the girl's nationality. A german citizen can't be deported and the integrity of a family is protected by the constitution. Minors need their parents.

glad to see that you agree with me. By the way, the daughter is NOT a German citizen as she does not qualify, both her parents being foreigners.

The not so little girl (she's 14) is definitely a German citizen, with a German passport. For some reason though, the parents have been denied residency in Germany. Another point that's come to light, is that if they'd managed to stay a little longer in CH, their status here would have been such that they could not be deported to Germany or anywhere else.

What is really sad is that these "realizations" take effect immediately. I know authorities are not supposed to double for psychologists but I think it would be a better world if families weren't scooped up like this and thrown out. And I totally agree with the arguments that one's place of birth is an unfair basis for determining whether that person is worthy of something or not. I've always found it weird that while citizens of some EU countries are allowed to stay for some time looking for work, others cannot. As far as I know this has just changed (don't quote me on this!) but the group of the favored is still quite small all things considered... I don't know how it could be done but it would be awesome if people could enter and look for work and were checked upon after a while, and if they were doing good they could stay. I mean I don't really care where all the hardworking guys come from. It's inevitable that others benefit from our taxes -- I'd just rather some worthy people did. I hate to think that our extremely loud, potsmoking, French neighbors do. If I could decide where that money goes I'd give it to a fund teaching in Kosovo or something like that.

I'm sorry to hear that. Persistency and resourceful legal support can work wonders though. I keep my fingers crossed for them.
