Nothing to back this up with, but I've been told that cases were tried in CH but there have never been any convictions. This is why people are saying that is legal (here in CH).
Ok, what that is saying is not that it is legal, simply that no one has yet been found to break the law hard einough to warrant a conviction. Slightly different - but in most cases what happens elsewhere in the world.

The thing is that we (consumers) already pay the publishers each time we buy our data carrier (blank CD, DVD, Blurays, HDDs, SDDs, Flash drives, etc). It is called SUISA Gebühr.

It is a fixed amount per GB of storage capacity that is included in the price and goes to the association of publishers. This was sort of a compromise taken in 2007 I guess.
