Someone backed into my parked car

My car was parked for a few of days in a rented (ie: numbered) spot. I came back and noticed the side was damaged, like the person in the next spot came in at an angle and hit it. All the spots are numbered and rented so it's probably easy to find out who rents that spot. On my windshield was a note saying (in German) basically "I backed into your car last evening, please call me" and a name and number to call. Judging by the "last evening" part, I guess they left, then remembered the spots were numbered and would eventually be found, and then came back the next day and left the note Both my doors are pushed in and altho functioning would probably need to be replaced. I'd guess repair bill would be maybe one or two thousand CHF, maybe less, I don't know.

Anyway, to the "question" part of this post: what's the protocol for something like this? They give me their insurance info, I get an estimate from a garage, and then their insurance pays it? Or maybe if it's not much, they would prefer to skip the insurance and pay me directly so their premium won't go up?

Any advice or experiences welcomed

Phone them.

If they pay, you're good, who cares about insurance.

I got rear ended (bike, by car) in Italy, guy left his card. I phoned an Italian dealer I knew, described the damage, and by the time I showed up for the parts, he had already paid! (probably wasn't his wife driving).

Phone the person. There is an accident report that they need to sign, stating that they are responsible for the damage. That paper gets turned in to his insurance company.

Happened to me on the street. A Good Samaritan left the licence plate number of the wrongdoer (a van driver). I gave all the information to my insurance company. After a few days they told me to get the car fixed. After about six weeks. they refunded my deductible, meaning that the other guy's insurer had paid them. Whatever reporting had to be done was taken care of by my insurer, complicated maybe by the fact that it all happened in London.

I met with the guy who hit my car and left the note. He admited hitting my car, but then tried to squirm out of it by pointing to one small spot and saying he did that, and that the majority of the damage he couldn't have caused and must have been there already (). I told him I know what my car looked liked and assured him there was no damage beforehand. Anyway, we agreed I would get a quote (offerte) from a repair garage and he would send it to his insurance company.

I got the quote yesterday, and to repair the dented doors is 5,000 CHF (). I bought my car 5 years ago for 8,000CHF. In my mind it makes no sense to repair the car, and I'd just rather take the money and apply it to a new car. Is that possible? I spoke to some people, and they generally tell me that the insurance company pays the garage directly.

that is correct. I know in the US you could negotiate with the insurance co though... and in your case, for example, you could offer to take 3k just write off the car. You win 3k, the insurance co wins 2k, and everyone is happy. don't know if they do that here ..

The answer to your question is Yes & No....its complicated.

Insurance company's liability is towards the damage done to your broken car and the only way you can get paid in cash by Insurance is if your car is damaged to an extent that the cost of repair is more than the current value of your car.

If you can convince them on the point that your Car's value is some 4-4.5K and the damage repair is costing 5K, then they might be interested in paying you those 4-4.5K.

Evaluate these points, get a quote for your Car and discuss with the other Insurance Company in question. Good Luck

It is possible but extremely difficult to do. I tried to do this with our insurers but given the amount of time and hassle I was experiencing, in the end I just gave up and got the car fixed. The insurance company paid the garage directly.

The insurance may write the car off & let you keep it for a 1000 CHF deduction, or they will pay you out in cash less the VAT. Insurance is very straightforward in CH.

I think it is the standard policy of Swiss insurences to not pay repairs, if it is cheaper to buy an equivalent replacement (same make, same age, same general condition). I've heard, that they can be quite conservative in estimating a car's value . So you most likely will just recessive whatever money your insurer think your car is worth.

Note that if you should chose to keep your car. The insurgence will deduct the current value of your car (after damage) from, what it otherwise would pay.
