Car scratched by garage in Germany

My car was scratched by ATU in Konstanz, I have no doubt it was done there. I complained to the manager. To my great surprise, he started shouting at me saying that this is just a little scratch and I should get the car polished. With my little German, I said they should get the car polished and pay for it if he think that will sort it out. He refused point blank and was shouting as if I was the one in the wrong. I must add at this point that he did not deny at any time that they scratched the car.

What shall I do? Any advice will be welcome.

Is the car insured?
If so - call you insurance - state what happened - and they can chase ATU.

How big is the scrarch? (Photo??) And are you 100% sure it happened at ATU?
Where is the scratch? What was the car in for?

Ok, I don't have a car. Moved it to Transportation/driving, though it may belong to the Insurance thread.

Well quite frankly, unless you can prove that the car was scratched there, I fail to see how the garage could or should be held responsible and liable to pay for the damage.

Normally, liability insurance (his) would cover it, but that would require the guy in the garage to agree that he's at fault and be willing to go through his insurance. If he's not - and again, you have no proof, well that's too bad for you.

You can try to use your Kasko or Parkschaden, if you have it.

General Liability insurance generally does not cover motor risks, cars are insured individually for 3rd party.
