Letter from Inkassolution

Hi,

looking for a bit of advice.

I had a deal with a company where I get 30% discount on their products for promoting them. I made an order but was sent a bill for the full amount. I got in touch to ask for an amended invoice with the discount and was told I would not get it as some of the products I ordered were already on sale. Never had it been mentioned that the 30% discount was only for normal price items and I've ordered from the company before and received a discount even on sales items.

I told them I wasn't happy with this and I have been marketing their products but felt they weren't honoring their end of the bargain. I sent them a long email explaining this and never got a response.

About a week after this I received a letter from Inkassolution claiming the full amount of 182.50chf + interest + 149chf OR Art. 106 + Adressverifierung 23.90 chf

So in total 356.05 chf.

I have read several chains about how to deal with this and how they shouldn't be allowed to charge me any extras.

Would really appreciate any advice on how to go about this the best so that I am not left with a bad credit history.

How long after the original invoice?
Pay the invoice amount, maybe interest too but not the rest and ask for evidence of their damages due to your non-payment.
You should've gotten the discount on the original order. Seems strange to say get an invoice for 100 but only pay 70.

No it's a swiss online retailer...

They sent me the invoice about a week after I received my order and I contacted them straight away for a new invoice for a discount.

They took a few days to respond, saying I wouldn't get the discount I was promised etc. I then contacted them again with their original proposal, saying nothing about no discount from discounted products and my previous invoice showing that I got the discount from the discounted products as well and again requested a new invoice.

The next thing I received was about a week after that, which was the inkasso letter.

Should I pay the company or the Inkasso? And how do I make sure it doesnt leave a mark in my credit history?

I had a similar issue once and it was a back and forth.

Especially if you don't want a mark, I would recommend calling the Inkasso. They can advise you as well a bit and also extend the time you have to pay.

I guess at the end there is no way round in just paying, and if you really want to go to the next step, you contact a lawyer. It is a pain and I decided just to pay and forget it

No! Don't just pay. Never! Pay the initial amount, directly to the seller or the Inkasso if you want but ONLY the inital amount (and if the payment is late the "Zins" which should be very little).


They are NOT allowed to Charge you Verzugsschaden or Adressüberprüfungskosten. Do NOT pay them. Send them an E-Mail with the letter as proposed here https://www.konsumentenschutz.ch/the...t-musterbrief/


They are only trying to scare you and like the post I just quoted it's People who "just pay" is why they Keep going!


Just ignore them if once you have paid. They would have to sue you and that has not been done once because they would Need to prove that they indeed had a Verzugsschaden which they can't.

Just to clarify, I have no further knowledge in law and this was only my opinion. Seems like irish_temptation knows much more there!
