Yep. That's why if an expat says to his Swiss girlfriend "I plead the fith" she may most likely not understand it.

But afaIk there is a law in Switzerland too that you don't have to answer (even in court) "wenn Sie sich damit selber belasten" (if you might incriminate yourself). That goes for witnesses too.

I have no means to "go to a judge" directly, I am sure you know it all starts with a police officer who's job is to take data(interview), process it and forward it to the next instance if it is plausible. It won't help the case if the judge gets partial, skewed data.



Now what can happen to anyone living in CH, which is by no means a "some hellish totalitarian state", is that a police officer can refuse to take all evidence, make up their mind by speaking to a non-involved 3rd party(ignoring written evidence by saying "Es interessiert mich nicht") and downright accuse you of being at fault yourself - the proverbial "selberschuld" narrative, without any facts to support their "opinion".



Fatmanfilms has outlined such a possibility in great details. All I wanted to say with my initial comment is that shoulda-woulda are BS from cinema, in real life it will all depend on whether you get a neutral officer, or a biased POS. Good luck anyway.

Yes but how can i prove i have not ordered ? no way .. if they send something extra is not my mistake.

Surely it has to be proven that you did order by the other side, not the other way around?!

The burden is on the Police to prove guilt, not the accused to prove innocence
