yes, I know the "live and learn" sentence. Thank you for your feedback. You are not teaching me anything. What I am saying is that it would be fairer if any leisure activity would be paid monthly, and not everything in advance.

Well it wasn't and you accepted the terms. You initially said you had only received 1 month out of 3 and now you say you paid for 10 lessons and have not received 4 of those lessons. Which is it? Did you start back up again and now want to cancel?

Re: How to get refund because of corona virus

I'll get a groan or two, but lots of non-obligatory schools applied for income loss support and they got it....at least the ones that declared all their income during the good times. Teachers were also on kurzarbeit/RHT, once again only applies to teachers who work legally. If everything was done legally, the suffering was minimized by all the available help. There's no moral/ethic basis to deny a refund, it's like airlines not refunding after they got help from governments.

Unless the school has specific T&Cs where it says "no refunds in any case" and the school can prove the customer was properly informed (signature on contract), the school needs to refund. So, is there a contract? What are the terms? xeon has been too vague on this.

Yes, it would be fairer. Happy now?

It would also be fairer if everyone had a living wage, enough to eat, clear air and water, decent shelter, access to decent medical care, free to live their lives without being harassed by the authorities on the grounds of your religion or skin colour etc...

I agree with you entirely. I'd say xeon is owed a refund. There would even be an argument to refund the full amount. I'd recommend writing a kind but clear letter stating they should refund the money. You could decide to take a new course at your discretion.

Xeon story has changed a bit and is posting garbage on other threads so she could be a troll and this could all be made up. However, the latest post is that she paid for 10 lessons and hasn't had 4 (completely changed from first post) so why the heck would there be an argument for refund in full

Only possibly if the dance teachers were employees and had been put on Kurzarbeit. Or the dance teachers were not employees and the school just pocketed the money, leaving the teachers without income for a few months.

I could tell you but I'd need an invoicing address ;-)

The 'School' has other overheads not just salaries.

I don't contest that. That's why I said "possibly" in the face of Lander's certainty.

No, there was no contract. What they have said is that I could pay for a new package of lessons, and they would deduct the missing classes to the new package. I said that I didn't want this deal because the Corona virus also affected me, and there was no assurance that the classes would be interrupted again, and then I would lose more money. They did not allow me to take the missing classes in the new course, and then stop. I really think that they were dishonest with me.

No, this is not a troll. Yes, I have written the wrong number. I had just 4 classes and I had more two months of classes.

No contract? Theoretically you could start a betriebung for 160CHF, but little or no evidence means the bretriebungsamt probably will not do anything. Also, forgot who told me betriebungs under 1000CHF are not worth the hassle, maybe other EFers know more.

I guess the lesson on the consequences of giving money away without a contract is much more valuable than 4 dance lessons, so it was a cheap one. Time to move on.

@Axa, I didn't know that I needed to sign a contract. Are you saying that if I take swimming lessons or dancing classes, I always need to sign a contract?

Nope. But you've almost certainly agreed to a verbal contract, especially once you've started using the service.. And if the T&Cs are published somewhere where you could reasonably expect to see it, you'll be bound by them.

Yes, small business such as non-obligatory schools usually give you a 1 page registration form. In this registration form you put your name, address and signature. Somewhere in the registration form there's a 1 sentence reference that usually say that you agree to their terms and conditions which can be 10-20 pages long. This registration form is the CONTRACT between you and the school. I took German lessons last year, forgot to pay the invoice on time (260 CHF) and they sent me a letter reminding me to pay or they start a betriebung against me. I fail they claim, if they fail I can also claim something.

If the small business is doing everything right (paying taxes) you can expect a registration form/contract. Sometimes teachers just rent a room for a couple hours a week in a dance school , you pay in cash but this belongs to the black economy.
