Change in Contract - 50% from 100%

Hello

I need some advice on whether my employer can change my work level from 100% to 50%, without giving me the time stipulated in my contract as notice. I have a 6 months notice period. They have not as yet stated when they want me to go to 50% but I suspect it is as soon as possible. I would like to ask them to give me the 6 months notice period and then change my contract to work 50%.

I have been working with this company for the past 5 years and now it is under new ownership but the old employment contracts remained.

Any guidance/advice would be most appreciated. This is a unfamiliar situation and I am a bit nervous of which approach to take.

They can only do so if you agree.

However, if you disagree to the 50% at the time when they want, they can terminate you (though not before the 6 months notice).

You can get free help by contacting your local RAV / ORP unemployment office.

I believe that they can force you to change your working hours from 100% to 50% but the company must give you the notice required as stated in your contract.

Be careful. Did the new company inform you they would be keeping you on in employment, or do you still legally work for the old company?

Often you would all have been given the written agreed notice to quit, and then be offered new contracts, less money more hours, etc etc.

Ittigen to your question - We were bought by the new company in December 2009 but have been a standalone company since then. There was no integration into the company that bought us. All the "acquired" employees have remained with their old employment contracts.

HR is advising me to take the 50% contract and then apply for RAV assistance for the remaining 50%. Is this possible? My concern is that after I complete my current assignment which my take another year they will make me redundant and then how will that look in the eyes of RAV?

I strongly recommend to get in contact with the Union asap, as mentioned by a previous poster.
Don't agree to anything, that's seriously dodgy what this company is trying.

I would be pretty sure RAV would not pay up (any of) the other 50% unless the company has honoured your notice period. Also, consider that anything from RAV will probably be capped against a total salary - if your salary is high, you may find that 50% from your company still comes reasonably close to their cap and that RAV (even if they did pay) may only pay a little extra.

The RAV would be happy that you accept 50% instead of being fired. The max insured salary is approx 10500 a month & they will pay 70% or 80% if you have children.

I am freelance some months I earn a good salary other months zero, if I earn 1chf less than 70% of my insured salary they pay 70% of the differance. If I earn 1 chf more than 70% I get nothing.

60% earnings will be suplimented with 28% making 88%! Likewise 50% earnings will be suplimented by 35%, making 85%. Thats assuming no children, with chidren to support it would be 92% & 90%.

The company can also do a reduced hours deal with the RAV if there is a possibility of returnng to 100% in the future, the company pays the hours you do & the RAV pays 70 / 80 % of the difference.

Thanks again for the responses... This forum and its members are a wonderful resource particularly in tiring times. I hope that one day I will be able to provide someone with the same assistance that has been provided to me.

The latest is that the company will honour my 6 months notice period and then start me on 60% as of Oct 1st but will change the contract to a 3 month notice period.

I guess this is a reasonable solution at the moment. The only issue now is if they decide to fire me while I am 60%, will RAV only give me 60% of the 126k and then 80% of that, or is RAV only interested in whether or not the insured income is equal to or over 126k and then will give me 80% as I have a child.

As long as your new earnings are less than 70% or 80% of the insured earnings you will be compensated for the difference.
If you do some overtime or part time work, then the calculation can be done on a month by month benefit, the advantage of part time work (even lower paid) is that the benefits don't run out & after 24 month you are able to start again!
