LUNAHK has no particular reputation at present
Unemployment benefit if you set up our own company

My hubby has been 'excused' from work starting from next june and we want to take this chance to start our own business but giving that to start up the business is all money going out and nothing going in i was wondering if the unemployment benefits (which he is entitle) will stop the moment the company is made or the moment the company start making money. Anybody has some experience with this?

As I understand it, if you are a director of a company, then you cannot claim unemployment benefit even if your company doesn't have the money to pay you a salary. In order to get the benefit, you have to close the company down.

I would be delighted to be proved wrong in this.

Indulge with me please... what if you are not the appointed director but in the board of an anonimous company? In any case do you know where can i gather these info , maybe some swiss law web site or else. thanks again

Check out the Social Security Threads in the Insurance section of the forum. There are quite a few links there to official or semi-official sources.

Probably one relevant point is that you have to be available to take up work and you have to be actively looking for a job. Do these two things apply to you?

being a shareholder of an SA does not make you an employee. If the shares are bearer shares, they belong to the person that holds them or his representative. If however your husband is working for the SA without declaring it, even if he suggests that he is not deriving an income only a dividend, the authorities will audit the company for avs declarations as to who is working there.

My understanding is that RAV can, at their discretion, give you a 3-4 month 'break' from actively seeking a new job to enable you to focus on setting up a new company. However this is something you have to discuss with them in advance, and submit a business plan.

Not sure if this policy varies from Kanton to Kanton, but knew someone who did this a few years ago. It sounded like a great deal, a win win for all.
