I completely agree. I think the employer is simply taking advantage here.
They would never dare do this to a local.
As an unpaid employee, you should stop all further commitments and stand your ground.

Er, no. Ignore all of them except of Ittigens first one... (because this is not America, nobody gets up-front payments except of freelancers, and sex workers are completely legal here)

Working without a contract is illegal, both for you and your boss. Stop doing so till he keeps his promise and comes up with a contract dated back two months and pays you. Be prepared to walk away as no somewhat serious business would let you work for two months without taking care of all the legal obligations from retirement fund to taxes. Inform yourself about the legal system and if your boss is not changing his attitude quickly openly tell him that you will both sue him for the money and on the way report him for not fulfilling any of the legal stuff a company owner has to do. He sure as hell does not want to have anyone from the migration office to the tax authorities on his arse.

Verbal contracts are legal, however, no need for a written one. I made a verbal contract 21 years ago, never have had a paper one.

From your previous posts I see your "employer" is in Zug. You have not said what kind of work you do. Do you work for a large, international firm? They should know the rules, and know they are breaking them. You are as well and if caught, you will be in a lot of trouble. What kind of permit do you have?

Do you have any proof that you work there? Anything? A lunch key for the cafeteria perhaps? An email account? An id card? A uniform or work clothing? A time card?

There are serious consequences on both sides. Consider if you were to have an accident at work.

You should not be working there. I don't see any reason why they are going to pay you, 2 months is a long time.

Why not name the employer? Better to warn everyone of companies out there who take advantage of people.

Sure. As long as the employer registers you with the AHV and all the other stuff... pays your Quellensteuer if applicable (most likely in this case)... and I would make the wild guess that an employer that did not pay the salary did not do the less easy stuff either.

Hi guys,
i read your comments, thank you for your opinions and suggestions.
No i didnīt get paid yet. Days go by, i call him, but he just keeps promising ''oh you know itīs the beginning, and for me it is hard to start'' and so on and so on... of course i donīt give a damn if itīs hard for you, i need to survive somehow here. For example i called him last wednesday and told him that i want to go to visit my family on easter,i need my money. he told me ok ok now i donīt have money,but tomorrow iīll call you and iīll give you money. of course on thursday it was even ''better'' - he didnīt call me, he asked a girl (she works as a secretary there) to tell me that he is very sorry, he canīt pay me today, and he has to go back to his country for some time...so i spent my easter here alone of course....
Yes i work in Zug, my position is Operations manager, itīs a new company, and i donīt want to mention here more about it, i donīt want to be that ''badguy'' and spread a bad word about it...maybe itīs because that my boss is from India and mybe they are mingy ( no offence, iīm not a racist or something, just heard this opinion, and for me itīs the first time when i work with Indian guy)...

I think at this stage you can assume that you won't get paid out of the goodness of his heart so you will have to take some proper action. Start by sending him a registered letter (costs you CHF5 at the post office) stating what you are owed and confirmation that he is paying all your stoppages.

Keep a copy and a receipt of the letter.

Keeping a written trail of the situation will help you if you need to enlist the services of lawyers.

Forget about trying not to be the "bad guy", he's probably counting on you being too nice to rock the boat.
