Lawyer recommendation for employment contract negotiations in Lausanne

I am in need of a lawyer to help me negotiate an employment contract in the Lausanne area. I am hoping that somebody on the forum might be able to make a recommendation. (It would probably be slightly better than blindly searching for one on the internet)

A little detail:
I will be moving from the US to the Lausanne area, and have received an employment contract in english. I would like to have a lawyer review it before I sign anything. I am specifically worried about the non-compete section of the contract. It seems to be too vague, quite long, and offers no compensation.

Searching on the forum turns up a couple of threads about non-compete clauses, but the advice mostly boils down to "talk to a lawyer." I have not been able to get a reference to a Swiss attorney by asking people I know as well as a local attorney. The local attorney agreed with my assessment of the non-compete clause.

Any recommendations for english speaking lawyers dealing with employment contracts in the Lausanne area would be appreciated.

Thanks everybody, this forum is an excellent resource!

if that's the main issue, then maybe you can first try by asking them to strike out that clause?

I have been in communication with them about it, but so far they haven't offered to revise or strike the clause.

I am not an Swiss Attorney, but I am a lawyer.

The term of Non-compete clause means that one party (employee) agrees not to pursue a similar profession in competition against another party (the employer).

You might want to read the section as from page 294. It will give you a bit more of an overview.

Re: Lawyer recommendation for employment contract negotiations in Lausanne

Thanks everybody for your responses! I have an update; Boris was out of the office for the week, so I contacted Pascal from the http://bern.usembassy.gov/vaud2.html link. He reviewed the contract for me and advised me on Swiss law. I was then able to negotiate an acceptable version with my new employer.

Article 340 covers non-compete clauses and places limitations on their duration and scope. Depending on your situation it might be OK to sign and rely on the law to keep it reasonable.

Just as in the other threads; If in doubt, contact a lawyer. I am happy with the service that I received from Pascal. I have pasted his contact information below for the future reference of anyone reading this thread:

DE PREUX Pascal; Rue du Lion d'Or 2, CP 5956, 1002 Lausanne. 021-343 2040, fax 021 312 2011. E-mail - pdepreux@lion-d-or.ch

With my contract negotiations finished, I'm off to post in the Introductions forum!
