Employer overpaid me

Hello,

Last year (2011) I was paied diferent amounts every month. I asked to HR several times about that. I could not understand. I even post it here too, trying to find answers. withholding taxes changing everymonth

The year finished and I did not recieve any answer/explanation from HR.
In February a new HR started. Since then my payment is alright, I get the same amount everymonth.
I mentioned to her last year problems (I am a F§*'~# big mouth!!!), telling "I believe at the end of the year,after all the recalculations everything was ok, but I just do not understand." Just an inocent comment from my side.

Now, the HR come back to me that they look in my last year payments and I was right, they were wrong. I was overpaied 340.- CHF in the whole year! So they will deduct from my next salary.

7 months after 2011 was over, 5 months after I did all my tax declarations...now they want this money back!!

Is there anything I can do to avoid they take that money from me?

It was their mistake, and I mentioned several times last year...

Just wondering if there is any legal point where I can hold.

Not a good idea to take legal actions for 340.- CHF, when you still want to work for the same employer.

Though you can definitely claim back the extra tax you paid on this amount :-)

Not a lawyer but I would say if you are overpaid then they should be allowed to take it from your salary, no point trying to argue with them, mistakes happen and it could have been in your favour in which case they would have had to pay you.

The tax will be added to this years tax so you can just settle it for the next filing.

Ask them to take it from your salary in 3x monthly installments so that it's less of a hit for you, they should be able to arrange this no problem.

Reading your previous post it looks like it was the WH tax that changed from time to time. If that is the case it sounds like the wh too little tax on your paycheck and not paid you too much?? If you already filed your taxes would'nt that already have been taken care of then?

If it was your pay that changed month after month and they overpaid you, then I agree that it wouldnt be worth it and that it would be hard to argue against as you were fully aware they paid you too much.

Is the witholding taxes what were wrong. The Gross salary was ok, but they make the mistake in my Tariff level, so I was deducted a wrong %.

It is not only the money, it is that I told them many times something was wrong and they ignore me...and 1 year after, VOILÁ!

Anyway, the 3 months is a good idea. I will ask for it.

That´s the thing, the WH tax was wrong. They deducted over the whole year not enough...340 CHf less than they should.

And yes, I did sent all my papers to the Canton Steueramt back in March. that is why I thought that everything was alright.
