Holiday Rights

I have a question and hope that somebody on here will be able to help me. I work full-time and I am entitled to 20 days holiday a year. Yesterday, I received a form from work announcing when the company will be closed for holidays next year. I was informed that I will have to have these particular weeks/days off and it will come off my holiday allowance. Now if this was just the case for a week or so I wouldn't complain. Unfortunately, these weeks cover about 90% of my holiday allowance. My best mate in England is getting married next year and theoretically speaking I won't be able to go as I have no holidays left. Is it actually legal to order the employees when exactly they have to take all of their holiday allowance? Surely I should be able to decide myself when I want some of my days off. Thanks for any help.

Depends on what your contract says and what industry you're in. Many businesses like construction firms for example seem to have set holiday breaks in the summer and you won't see any work being done on building sites.

My OH gets 25 days I belive, but 3 of those days must be taken during the Christmas to New Year week, it's a rule of the company.

So yes, if your firm's contract allows them to set holiday dates then you will have to take your holiday at that time. However, there's nothing to stop you talking with your boss and explaining that you'd like to have time off for your friend's wedding to find out what you might be able to arrange. Does your firm work on a core time system or set number of hours to be worked per week? If so, then maybe a few hours overtime would give you the days you need.

We have that in my company too, the office closes for a week during christmas and new year, but we can choose to work extra hours (1.5h per week every week of the year) to compensate for this.

So you see, two different methods of dealing with the same holiday situation. I think the Swiss do this sort of thing more than other countries do. You really need to look at your employment contract and what it specifies there.

By law the employer can order date and duration of the holidays. He has to announce it well in advance and to take into consideration the situation of families with children in school. (Art. 329d OR)

You can always request unpaid leave or offer to work additional hours at other times of the year to balance your need to take time off for your friend's wedding... whether or not your employer agrees will depend on them... at our workplace we tend to give such requests a positive response as we value the loyalty of our staff...

Thanks everbody for your help. I work set hours and overtime is not an option so that rules that out. I will try to speak to them but the possibilities of any overtime or extra days off are slim as they are not very understanding.
