Cleaning lady and official holiday pay?

Hi all!

We have a cleaning lady under contract who cleans for us Monday, Wed and Fri a certain specified number of hrs.

If one of the days it is an official holiday (i.e. 26th of Dec in Kanton Zurich) my assumption is that she gets paid but does not work.

Am I understanding the law correctly on this point?

If you pay a salary then yes it's a compensated day. If you pay an hourly rate with holiday percentage then no.

I pay an hourly rate but the holiday % I add is to compensate the 4 weeks holidays. To my understanding it does not compensate bank holidays and if her working days fall on a bank holiday then this should be compensated.

Is your understanding different?

Don't feel taunted but can you clarify what you mean? We use the standard contract provided by Ktipp and in the contract itself there is nothing mentioned on this.

I checked out Ktip and it states that employers on an hourly rate don't have a right to be paid out on public holidays. However as a private employer you can compensate her if you wish.
