Employers rights to health records.

When my wife started her job she had to fill in pre-existing health conditions form covering health issues over the past 5 years. This was for her employers health insurance to cover 80% of her salary should she fall ill. She sealed it in the provided enveloped addressed to the insurance company. No problem with this apart from the fact the employers' HR rep opened the envelope in front of her and read it on her first day!

18 months down the line she has been told she has an inheriditry illness that requires time off work and a probable operation or two. Does her employer have access to this information insofar must she tell them the nature of the ilness or is a statement from her doctor that she requres treatment sufficient? I'm guessing their insurance company will want to know the details. Are they able to pass on this information to her employer?

I would think, as is normal anywhere, if she needs time off work and is going to get sick pay, then she will have to tell her employer why and provide them with a sick note from her doctor.

Thank you for the reply Mr Monkey.

Does she have to state the nature of her illness? The doctor will of course provide the sick note. But she would rather not have her employer and colleagues knowing the details.

The doctor's note will not state the nature of the illness, only the % of working time possible / not possible, and the duration. The employer does not have the right to know the reason for the absence other than "sickness".

If the insurance companyt wants more details, they will write to the doctor. They may ask your wife to sign a "right to disclose" letter that they will send to the doctor(s). I was the situation of sickness without wanting the employer to know the details, and signed the letter, but added that the insurance company was not allowed to disclose any information to the employer other than expected timeframe for return to work
