Work Permit application for Dependent Working in Switzerland

Hi Forum member.

The situation is :
- I am working in Switzerland on B-Permit.
- As my wife joined me as B-Dependent she was eligible to find work and is working as a contract employee.
- Now my permit is getting over in August 2016 , and most probably the extension will not happen due to change is Swiss laws that post 4 years permit renewal wont happen.

My question is can my wife's company apply for her work permit while she is working on B-dependent permit.
Do you see any bottlenecks in this process.

It's not possible to change a non-EU dependent's permit to an independent one. It's quite clear in the Foreign Nationals Act.

"The possibility of gainful employment for family members is related, according to art. OASA 26 and 27, to the duration of the authorization of the person granted family reunification. If the residence permit of the spouse is not renewed, the members of his family cannot claim a right to pursue their gainful employment (art.6, para. 2, OASA)."

She has her permit because she's your dependent. If you lose your permit so does she, despite the fact that she's employed here. It's part of the conditions for getting the dependent's permit in the first place.

Not an expert here but i think it makes sense that your wife checks with her employer on the possible options. May be they process a B or L resident permit for her - a fresh one.

It was possible albeit difficult before. Do check with the authorities. However, I think her being a contractor will minimize the chances of success.

Dear members

A follow up question, since my wife is currently living in Zurich and working in Basel. Is applying for independent WorkPermit in Basel while living in Zurich is a problem since she has a residence B-permit from Zurich that allows her to work.

She will need to get permission to keep living in Zurich as usually non-EU B permit holders have to live in the same canton as their workplace is based in. She'll need to talk to both Basel and Zurich migration offices about it as they both have to say yes.

Thanks, can we tell them that will be moving to Basel once the work permit is granted.

*dealing with authorities is so tricky * Seems like each statement we make can have a negative effect *phew*

Not if you're lying about it. A quick way to get the permit revoked I would guess.

Where you live decides who gets your tax money which is why both cantons have to agree to the move. Basel will have gone to a lot of time and expense if they do grant her a permit and will want to see the benefit so will want her taxes remitted there. That won't happen if she's living in Zurich.

Additional Question : What is the minimum salary that one should be earning so the authorities don't question the Work Permit request.

Considering there is a dependent member.

Whatever is the amount they think is sufficient. It may vary from canton to canton as each has different costs, etc. Ask the migration office what figure they would be looking for.

4-6, 6-8. Could be longer, could be shorter. It'll depend on whether they need proof/more proof from her employer that they'd tried hard enough to find a Swiss/EU national. As a contractor particularly, she'd have to be very specialised for them not to find someone else who could do the job.

HI All

I am back , with another question

Currently my wife's application is filed with AWA Basel, 4 weeks over , awaiting response.
My permit expires on 7th Aug 2016.

- I would like to know in case the decision is not received till 7th August , are we entitled to stay in Switzerland or I will need to move out and only she can stay as its her application thats's in progress and not mine.

- There hasn't been any document(receipt) shared with us by the employer saying that the WP application has been filed , do they receive any for reference with application number.

Dear Members.

How do we get to know that the Canton has approved and sent to Bern, do they inform the Employer.

In our case my wife's application was filed 5 weeks ago and no word after that , so wanted to check if the applicant is informed after each major step.

Can employee contact AWA to check on status or should it be avoided.

waiting makes you anxious so all these questions!

Usually it's the employer who's informed as they're the ones making the application.

Dear OP,
Normally the first level canton approval is sent to the employer who in turn informs the employee. in this letter, it will be mentioned that the application is sent for Federal approval. so in your case, check with your wife's employer if they have received something.

Ya checked with them , they are doing it through an agency/lawyer , no News . 5 weeks over!! hope to hear from canton soon , thought of giving AWA a call then dropped the idea thinking lets not irritate them since the communication should be between Employer and AwA
