Residing in Switzerland but working for a company abroad

Hello everyone.

I just relocated from Spain to Switzerland (Vaud) for a new job and my wife will move with me in about 3 weeks.

Her current company (in Madrid) has offered her to work from home (from Switzerland, when she moves here) part-time for a few more months. They are still working on the actual agreement (hours, pay, etc) but the intention is to sign a 5 or 6 months contract (Aug-Dec2008) in which she would be working part-time for them while residing in Switzerland (working from home in Switzerland instead of in their office in Madrid).

Can this be done?.
Are there any Swiss Laws/Taxes/regulations that we have to consider on this matter?.
Is there anything she has to do?

Hope someone can help us out.

The easiest solution I believe would be that she keeps residence in Spain.

If both the employer and the employees live in CH and the company is registered in Dubai, where are the employees supposed to declare their taxes? Must they declare them in CH?
Someone told me of such a firm whose manager did not mention the name of the company in the papers for his employees with secretarial jobs. I think that was a violation of the Swiss law, but.... I don't know. Do you?

You must declare in CH your income if your residence is in Switzerland.

Furthermore be ware if your "Betrieb" is known to the Authorities. Thats for your employer should be interesting. If the "Arbeitsinspektor" finds out that a Dubai Company is doing an "Betrieb" in his area he will visit your office. After this the Ausgleichskasse and properly the tax authorities will be visit this office too.

Can you please provide translation for non English words as per the forum rules? This paragraph means nothing without it....

If the inspection du travail/Arbeitsinspektorat/Labour Inspectorate finds out (For example, the postman or neighbors) that your Dubai Company is running an établissement stable/Betrieb/permanent business establishment in his area he (the inspector) will makes the visit, counts the heads working inside this office and reports it to the tax authority and the compensation fund.

In Basel I already did see it. Properly in Zug or Schwyz it will occur less. So 1 Hong Kong company and someone from Panama retrospectively had to pay for many years a large number of social security payments.
