2 jobs - how legal is this

Hello,

I have a friend of a friend.. that work's full time for a company, has the opportunity to help a friend to implement a project in the Swiss market in his free time ( weekends, overnight, etc. ). How compliance is this to the legal system in Switzerland? Note that the 2nd Job area / market it is totally different then his actual position at the company that he work 100%.

Check your primary employment contract. Mine prohibits outside employment without express, written permission.

No, unless it's written in the contract.

Some contacts define that you cannot work whitin the same branch or share the same clients. Other like mine, forbid to work at all. Check the contract

and ensure there is no conflict of interests , if such employment is permitted and consider the tax position ...

If he has a contract with the second company that he is with, then you normally would need permission resp. you would need to check your contract with the main employer. If the work is done in free time, and not against the interests of the main employment, then it should not be a problem.
