Employer won't give reference letter

Hi,

I left my job (as I found a another one) at the end of July 2017 and STILL have not received my reference letter, despite requesting it in May 2017 when working my notice period. I have been repeatedly emailing the HR lady (who is based in Germany), also called her a few times, and finally emailed my direct boss. Each time they say "yes, sorry, just a bit longer..." and I know they are all overworked. I live (and the job was) in Kanton Zug. I left the company on reasonably good terms.

1) What should I do to get reference letter? Should I take some kind of formal legal steps, or will this just result in a bad reference because I annoyed them?

2) I also did not get any 2017 salary statement. Are they obliged to give me this? I need to complete a tax return.

For both parts contact the Arbeitsamt (Amt für Wirtschaft in some Kantons) of the Kanton your old job is located at. There's a bit more about 1) but these kind folks will inform you how to best proceed.

Additionally, inform your tax office around the date your tax declaration is due and request an extension This should be just a formality.

You could suggest that you write your own reference - then they only have to sign it. I ended up having to do that a few years ago.

Thanks - good ideas.

I sent a message to the Arbeitsamt (they have an online contact form), and also emailed the company again, casually mentioning that I had done this. I doubt they will give me anything unless there is an official deadline hanging over their head.

Thanks for the tip re the tax return deadline extension. The Kanton Zug tax deadline is 30 April it seems (longer than I expected), and it costs CHF 20 to extend it. I will hang on a little longer...

The fee may be an attempt to discourage lazy people. If I had to request an extension I'd simultaneously ask for a waiver of the fee because it's not your fault.

I am using my "rechtschutz" insurance at the moment for exactly your situation as my ex-employer did not provide these, it also turned out he hadn't paid my "quellensteuer", it's a long proces , we had the "schlichtungs kammer" last december and as he didn't turn up they gave me permission to go to the real court

The next step to escalate is the Schlichtungsstelle für Arbeitsrecht:

P.S.: the fee for the extension of the tax declaration is only for extension beyond 31 December. No fee involved for an extension in the running year.
