University Degree Requirement For Permit Type B Application

Hi!

I am currently a UK resident working for a international IT company and planning to transfer to it's Swiss headquarters(Zurich) in about one year. i do hold an EU passport.

Because i'm still doing my bachelors and will be doing so for about 5 more years because of distant studying i want to ask if it might affect the authorities' decision to grant me a permit B in case i do get a job offer in Zurich. Since the authorities can view me as unskilled because i don't hold a diploma.

In short - is the presence of a diploma a big factor even when the company has agreed to hire? Also what other factors might influence canton's decision(work experience, .. etc).

When you hold an EU Passport and get an unlimited contract from the company,
you will receive your permit B.

The company decides to hire you , diploma or not.
Not every foreigner here in switzerland holds a diploma.

But he is from Romania (with Bulgaria)), which means there is a contingent.
Specifically 249 B permit are liberated every 3 months at 8.30 (1st of June, 3 september and 3 december 2018 and 1st of March 2019) and it's first come first served basis. Also you need the permit before you start working.
I think that's the biggest problem, but it's not your problem it's the company's job to do this.
If you are coming next year these contingents will probably have gone away (they are prorogated every year), which means that if you have a real job you can come and they can't really deny a permit.

I recruited an Australian without a Bachelors without any problem back in 2002. It was just before quotas for EU citizens were abolished.

Maybe, maybe not. Will depend on the time of year he moves. Best to wait until after 1st June 2019.

"The Federal Council decided on 18 April 2018 to extend by a further year the validity of the safeguard clause ‒ a provision of the Agreement on the Free Movement of Persons (AFMP) ‒ for Bulgarian and Romanian nationals with regard to category B EU/EFTA permits of more than one year. This measure, which has been in force since 1 June 2017, allows to limit the number of permits for taking up gainful employment. Between 1 June 2018 and 31 May 2019, 996 permits B EU/EFTA will be available (as in the previous year).

Affected by the quotas are workers from EU-2 countries with an employment contract valid for one or more than one year or indefinitely wishing to take up employment in Switzerland and therefore applying for a type B residence permit for gainfully employed persons. The same applies to self-employed persons.

The Federal Council also decided to reintroduce quotas for short-term permits (L EU/EFTA), if the AFMP threshold will be reached by May 31, 2018. You will find here further information on this subject from 1 June 2018.

The transition period for Romanian and Bulgarian nationals will end from 1 June 2019 and they will enjoy full freedom of movement from this date.
Further information can be found in the Circular of 16 May 2018 and in the Directive on the Regulation on the Free Movement of Persons (VEP) (These documents are not available in English)."
