Two jobs 100% ??

Hi guys,



I was sacked but released on the spot. I still have 2 months of paid leave but in the meantime i found another job.



I know its not allowed to have 2 jobs at 100% but I was wondering if anyone can find out/catch me if I start the new job and still take my 2 salaries from my old job?

"Job start during notice period : In principle, employees who have been released unconditionally may accept another job during the period of notice provided the new job does not compete with the old employer. However, there is no entitlement to double pay."

Hi Guys,

I have found a new job and is not competing with my old one. However my notice period for current job is 3 months and new company wants me as quickly as possible. As I had a lot of holidays, i have used a lot of my holidays to be off on 3rd months in new company. is that a problem?

I do not think it's about double taxation. You are still employee of given company until contract is due (3-months) and you may ask company that you are on the termination period to release you and that results in not-paying you. That would allow you to start with the new company.

You also may inform your current company (and it's perhaps better idea) that you are undertaking second job with given company that is not competitive to your current employer and it's just that - information. Current employer may object based on some grounds (like you be tired and can't work 100% for them) but than again - you are on gardening leave I understand and been asked not to show up in office ?

why not work at the new job immediately. if no competition issues, I don't see a valid objection from the current employer if you're already on gardening leave.

In case of gardening leave would not be paid twice since your former employer can deduct the salary that you earn at your new job:

An issue is that you are not effectively on gardening leave but are on "holiday", and you are expected to take the holidays in "natura". It would some more research to see how that is dealt with in practice.
