Remaining holiday after resignation

I have recently resigned and will start a new job in coming January.
My current company is very small, and my boss asks me to take the remaining 7 days holiday in the end of contract. And he uses the word 'muss'...

Due to personal reason, I would still like to take some days before mid of December.
My question is: if I have the right to use the holiday in other days? Is there any way to argue about that?

Thank you very much for your advices!

Re: Remaining holiday after resignation

Have you spoke to your boss and asked if you can take them at an earlier date?

Re: Remaining holiday after resignation

I haven't yet. Our HR passes the message from the boss to me. I am still thinking if I could or should ask for that...
If there are common rules in all companies like that, I may still try to ask for a favor from the boss but not insist on that...

as oldhand says, just try to ask. he may not be so flexible, given as you have resigned however you should just be straightforward to explain your reasons (whatever they may be) - good luck!

Just ask, if you don't ask, you don't get. Just be aware that according to Swiss law, your boss can stipulate when you should take holidays, he merely has to try to take into account the employee's wishes.

Re: Remaining holiday after resignation

If I have not resigned my contract, the boss can also stipulate when I should take holidays without reason, right?

Actually, I have to fill holiday request forms every time before holiday. Since it has never been rejected, I just do not feel the law .

He has resigned and is asking a question for a hypothetical situation in which he has not resigned.

Correct. You have the right of having holidays and your employer has the right of telling you when you take your holidays.
