Unemployment RAV - What counts as 12 months?

Hello,

First post. I've looked through all RAV and unemployment posts on multiple forums and google with no luck. Hopefully someone can help?

I moved to Switzerland in January for 6 months of work and have been extended now until the end of the year. I'd very much like to stay in Switzerland and find more work. My actual start date was mid way through January so my question is - what will be counted as 12 months to be eligible for RAV. Would it be exactly one year on from my start date? Or would it be from the end of December (I have a January payslip with ALV deductions and will have 12 in total by the end of the year)?

I don't know this for a fact, but my interpretation is the following:

The law says: "Die Beitragszeit hat erfüllt, wer innerhalb der dafür vorgesehenen Rahmenfrist (Art. 9 Abs. 3) während mindestens zwölf Monaten eine beitragspflichtige Beschäftigung ausgeübt hat."

The way I read this, you have to have been paying into the ALV system during a minimum of 12 months, and I think this means having had a paycheck for 12 months. That would not mean that these 12 paychecks have to cover 365 days.

This seems to be supported by the fact that RAV wants you to file copies of last 12 paychecks.

Note that there is also a reference to previous EU unemployment insurance in case you do not have the full 12 months in CH but have been insured in EU before. Might be that this also counts somehow.

If you are on a temporary contract, are you on permit L then? This might be limited to the time of your contract then. Really no idea, but of course for being able to stay in CH, a residence permit is the decisive thing, not an entitlement to receive ALV.

Yes it's an L permit until the end of the year. I did think about what you were saying but I read another post on this forum that the permit can be extended with the RAV payment basically being your work contract.
