I would highly recommend using the sick leave option and talking to the psychiatrist. Actually, it may not be in his interest to resign whilst sick. He also needs to inform RAV that he has the advice of the psychiatrist to resign due to mobbing. It will help his case and possibly reduce the penalty / waiting period.

The Psychiatrist can even provide a letter to the RAV to explain the situation and support his case.
Can second this advice due to personal experience. RAV won't penalize you if you had to quit due to medical reasons, you will need a note from the psychiatrist. Good luck! No use in losing several months of income due to bad treatment. Hope he finds a better place soon!

Re: Employer wouldn't allow to take remaining vacation during notice period

Thank you guys for your support! I hope he won't be penalised or at least not to such extent. We managed to get a psychiatrist opinion before he quit so it will be submitted together with the all RAV docs. Also a reason for quitting the job will be explained accordingly.

According to our lawyer, this might not be enough reason to avoid being penalised especially these times but let's hope for the best... I will keep you posted.

It's important that the Dr states he is fit to work, RAV will not pay if someone is sick.

Re: Employer wouldn't allow to take remaining vacation during notice period

There are basically two separate documents:

1) From psychiatrist, received before quitting his job stating:
Quote:
2) From psychiatrist, received yesterday after his employer was very aggressive and threaten him:
Quote:
Herr XX
Folgende Arbeitsunfähigkeit wird bescheinigt:
vom 23.07.20 bis 31.07.20 9 Tage 100%
Grund: Krankheit
As a reason for quitting the job he will write: Gesundheitsprobleme im Zusammenhang mit der Situation am Arbeitsplatz (sehe: ärztliches Zeugnis)

The issue I see is that notice period is extended if you are ill during the notice period, for 7 days illness the notice period will extend a further month, this is probably not what you want.

No, this is only the case if one is fired, not if one quits.

If you give notice yourself and fall ill during the notice period, the period is not extended.
This was also advised by our lawyer.
