Holidays when quitting job

Hi all,

I am planning to resign soon from my job. I have 3 months notice period. Additionally I have 30 days of holiday outstanding for this year.

Can I take these 30 days in my last month of notice period? Are they able to refuse this and if they refuse, are they obliged to pay me 30 additional days or how does this work?

And also the other way around: If I don't want to take my holidays in this 3 months notice period, are they obliged to pay me out?

You probably only have holiday days pro rata? If you quit per June 30th, you will only be entitled to 15 days, not 30. Unless you quit now per 31.12.2021

You are right, I still got 6 days from last year though.

One question with regard to pro rata: Does it take into account the date of resignation or the end of the notice period?

The end of the notice period. You accrue until your last day of employment.

In general they can choose when you take your vacation i.e. make you take it or deny it, but they have to give you "reasonable time" to enjoy a break and to look for work. If you want to take the time off it's likely that you can regardless how the employter feels. If you don't want to take the time off, your employer can force it. If they don't force it they have to pay you for it.
