Late Salary

My company has consistently been paying my salary late. started off with a few days, then 10 then 20 and so on. Currently, it is more than a month late.

I have sent an email to the employer (small company) saying the situation is very bad and cannot go on like this.

His answer was that the government is late paying the support (as they are getting Covid support) and he cannot do anything about it. The company is currently looking for investors (broke) and he can't put any money into it.

I would be happy to find a new job but haven't got any responses to my applications as of now. I am a cross-border commuter, so I have shitty unemployment protection so I don't want to be laid off at this time.

How long should I wait before going to the authorities?

Salary for the last 3 months pay is insured. What do you want the authorities to do? Close down the business?

More than the authorities you should go to the union to evaluate your possibilities. First step would be a registered letter with a term.

He wants his salary (how does he pay his expenses, rent, etc), even if his salary has been paid only once late the boss should have considered closing as you have to plan ahead for these things so you don’t make everyone else shoulder your debt. I suspect the OP is not the only party being let down and should have been informed of the situation in advance...

If the employer has no money, can only pay when he gets paid. If the company goes bankrupt the insurance won't pay immediately & the OP will be out of work to boot. Been in this situation myself, I did get paid about 2 months back pay, the company did go bankrupt a few months later.

Not cashing the salary on time is being an unsecured creditor to a failing business. An interesting proposal at the right interest rate.

If the company fires OP, that at least gives access to unemployment coverage. Some of us have to pay rent

You are very much a secured creditor as 3 months salary / pension / social costs are insured.
