Penultimate Day had an accident

All,

Tomorrow, 31st March 2021 is supposed to be my last day of employment with my current company.

I was running to the Post Office to send by registered mail admin, related to leaving the company pension scheme. (or stay within as I am over 58, info they sent me is clear as mud)

I tripped and fell about 10 metres from the enterance and have multiple fractures in my right hand. Went to urgency, x-rays etc, now in a cast ...

Have informed the company so that could claim on accident insurance, filled out the form, attached my sick note too, informed HR too.

Supposed to hand my laptop, badge etc back tomorrow.

Does this affect my last day as technically I am signed off sick & also should I still sign up on chômage/RAV?

Re: Penultimate Day had an accident

Sorry to hear that - that's really bad luck. Hope it heals quickly!
As for employment implication, it depends - did you resign or was your contract terminated by the employer? If you resigned, the accident does not have any impact on the termination date. If this was a termination by the employer, your notice period would be extended by the duration of the sick leave.

When employment ends (regardless of who initiated it) you are normally covered for another 30 days for non-work-related accidents with a possibility to purchase further coverage under the ex-employer's plan.
This is not really relevant in your case as it happened still during employment.

Finally, if you resigned and your employment ends tomorrow, I am not sure you would be entitled to any continuation of salary or unemployment benefits as such (other than what you would have been entitled to without the accident)

Re: Penultimate Day had an accident

First of all, get well soon!
About the termination: it is very clearly worded here https://www.ch.ch/de/unfall-was-ist-mit-meiner-arbeit/:
Kündigung während Arbeitsunfähigkeit Wenn Sie nach einem Unfall arbeitsunfähig sind, kann Ihnen Ihre Arbeitgeberin oder Ihr Arbeitgeber während einer beschränkter Zeit nicht kündigen.
A loose translation would be:

Termination during incapacity for work If you are unable to work after an accident, your employer cannot terminate your employment during a limited period of time.
I have no idea, if that prohibits employer from terminating you according to your mutual agreement, but for any other termination that shall apply. This reading may be legit, unless somewhere else it is stated otherwise. [Only using a common sense here, not any any legal knowlegde, which I definitely do not have]

You obviously knew it without this reminder, but I still decided to state the obvious and wait here for more experienced and knowledgeable people - the topic looks very interesting.

Re: Penultimate Day had an accident

Not the same situation, but my husband was on a 6 month contract a while back and he had an accident in the month after he finished work. His accident insurance paid out as it is valid a month after employment ends. It paid for all his treatment, but also his salary as he was unable to start another job for a while. They just paid him an average of what he earnt over previous 12 months - even though he had no contract with anyone.

And then to the end of the month.

With the RAV, you certainly could go and talk to them but if you're not fit for work you're also not fit to receive unemployment pay. You'll get payments from the accident insurance.

Re: Penultimate Day had an accident

firstly, health/accident insurance covers you for 90 days after contract end IIRC, you were covered when this happened so insurance is no issue. Recover well.

Did you or the employer give notice to end the contract? If the employer did then technically they have to extend your notice period while you're carrying a doctor's note that you cannot work. One day sick in the notice period will give you at least a month of extra "employment".

Talk to the HR of the company.

The company terminated my contract due to restructuring. Been training my replacement for the last 5 months.

Seriously would prefer a hand that works, been told by several people to slow down as I have been fairly unwell these last couple of months and just carried on.

I did notify my companies HR of the accident and filled out the accident insurance claim.

Thanks for all the feedback, really appreciated.

Re: Penultimate Day had an accident

Someone just sent me this:

Errrr....noooooo....you can't go into the office to hand back the laptop if you are on accident sick leave.
It's binary here, you're either off sick or you're not.
Else your company & insurance will object.

Is that correct?

Rubbish. I went into work during my recovery period after an accident, to say hi and see how everyone was. Was quite clear I wasn’t fit for work, but no one had a problem with me popping by. Call your boss and ask though.

you have at least one month additional on their payroll then.

talk to HR and get a doctor's note to state you cannot work. This is important

Re: Penultimate Day had an accident

Just a quick update, my employment contract has been extended by one month and need to work the remainder of April if fit to do so.

The doctor who saw me last gave me a chitty for 100% for 7 days then will see me again. She asked if I can type with one hand? Yes but it's going to be slow.
