Working Remotely from Switzerland in EU

Hi Everone,

I'm a freelancer willing to work remotely from Zürich for companies in Germany or other EU countries.
I would be hired as an employee by those companies for the time of the projects (2 to 12 months, 100% employment).
I'm an EU citizen.

Does someone has experience with this, normally one lives in Germany or France and works in Swtzerland, I might do the other way around.

Are there any legal points to take into account?

Are these companies paying taxes in Switzerland?

How should this income be declared in my tax declaration (Steuererklärung)?

Who or where can I find help to make the tax declaration or get further information?

Hi,

I don't understand what you mean when you say "as employee". I take it as if you meant just freelancer.

If you have more than a company/ client you can register in Switzerland as sole trader, bill those clients for your work and then pay taxes in Switzerland.

It's very important you have more than a client.

Your clients wouldn't need to pay any taxes and, to my knowledge, not even Swiss VAT.

Until 100K CHF of revenue you wouldn't need to register in the commerce registry either.

Hi Javi,

so far I have been working with payroll companies in Switzerland, I would use one in Germany if I get clients there.

This is what I ment by "as employee", sorry for the unclarity.

Then I do not have to register as sole trader, right?

How would be with Swiss VAT,... would these companies pay this?

Unless you are a Swiss citizen, C Permit holder or a dependent permit holder, the first thing you need to figure out is how to qualify for a residence permit.

I already have a Swiss residence permit and I'm an EU citizen.

If I want to live in Switzerland and work as an employee using payroll companies in Germany or directly as a hired employee of a German company, how does the taxation would work?

Are there any legal concerns that I should be aware of?

I'm afraid I cannot help you much as I've never used/ been allowed to use such structure.

I think your German employer would need to go through some bureaucracy in order to pay Swiss contributions. There were some threads in the forum about it.

My own experience has always been that these companies will only payroll you (long term) as employee when you're in the same country.

Otherwise they would offer a Corp to Corp agreement (you being a sole trader, better a GmbH/ Sarl or using another payroll Swiss company) as is significantly simpler to manage.

The safest thing would actually be to ask these companies how they operate.

Why don't you contact the tax office of your reference canton?

There are probably other solution for your case but In my case , with a B permit, the immigration office told be that I would lose it if I stayed out of CH for more than 3-6 months (1 person said 3, another one said 6...they were next to each other)....
In addition to that, the tax office of my canton clearly stated that I need either a tax representative or an address in CH to receive their letters since they won't send those abroad.
