Accrued vacations after notice period

Apologies if this has been discussed before, but I couldn't find a good match for my question.

I will leave my current company (I have been working here 4+ years) in a couple of months, even though my notice period is 3 months we're discussing the possibility of me leaving the company earlier.

My question is regarding the number of accrued vacation days during this year. Assuming that my contract ends in the beginning of September (having worked 8 full months in 2021) I will have accrued ~16 days of vacations which, in my opinion, I should use before September.
However, it's being suggested that if I go on vacations before the contract end date, then the accrued days are no longer 16, because vacation days are not taken into account to the "worked period".
How many vacation days should I have (in August) assuming my contract ends in the beginning of September?

I'm not assuming A or B are correct but I would like to clarify this situation.

Thank you

That's not true - assuming you take vacation and not unpaid leave.

If you have worked from 1 January with a contract end date of 31 August, your holiday accrual is 8/12 of the number of vacation days per year.

And just be careful that you cannot loose any vacations basically as you can only loose them after 5 years and rolling (meaning any you use, the oldest ones would be the ones deemed used). So if you have more days from other years, these also should be paid.

Re: Accrued vacations after notice period

Thank you both for your replies and for the sanity check.

It is indeed vacations and not unpaid leave.
Human resources are implying that if the contract finishes September and I go on vacations 16 (working) days before then I don't actually have 16 days.
I'll try to clarify this mess.

Tell HR you are happy to have your days paid out 😉
