Remote Full-time employee from US company. How does it work?

Hello,


I got an offer from a US company to become full-time remote employee.
I'm normally a freelancer in Switzerland (all setup already) and pay my own 3rd pillar.


Now, is there any way that I can setup this employment "as if" it were a Swiss one and make them pay my 2nd pillar here, or is it impossible?


Some people say that I would probably need to still act as a "freelancer" and at the end of the year declare as if I was independent.
If that's the case, should I request to be paid all the benefits I am missing on top of the salary?



What do normally people do in this situation?

Before you do anything with this I'd check with your bank that they'd be happy with you having any association with the US. Many Swiss banks want nothing to do with the US in any way, shape or form due to the US's FATCA law. They see you receiving regular payments from the US and they may close down your Swiss account without warning.

One thing is your own nationality (if you're American you don't have many options to bank in Switzerland) and other one where your clients operate from (which nobody cares unless they don't comply with AML constraints).

You can perfectly open a bank account in USD in Post Finance or open it in transferwise receive your payments there and then pay your taxes in Switzerland.

What I used to do in the past was to continue working as a freelancer.

If the company is large enough they would know what to do and how to proceed in these cases.

Otherwise you can just try to come up with a no-frills agreement by which you invoice them on a monthly basis as a freelancer but you convince them that you'll have "the commitment of a full-time employee" (...). However as you may know to operate as a freelancer you usually need more than one client to avoid trouble.

In general, the smaller the company is the happier they're to engage in these kind of simple agreements.

There are three options:

1. "Anobag" (German name for "employee without a social security registered employer")
- The Swiss based employee is responsible for handling the social security and pension payments, which can be reimbursed by the non-resident employer. The foreign company is the legal employer.

2. A payroll service
- The payroll service legally employs the Swiss based employee and invoices the foreign contracting company for its employee's services. Payroll service handles social security and pensino administration.

3. Own legal entity, normally a GmbH/ sarl
- Employee sets up a legal entity which legally employs the employee. Legal entity bills the foreign contracting company.
