Is RAV support extending your Work Permit ?

Hello there,

I have a specific question regarding how RAV will support during unemployment.

I have lost my Job due to recession and now I am serving my notice period which is till end of April 2009. I have registered with RAV and waiting for their call. Mean time my Work Permit ('B') expires exactly the same date when my notice period comes to end. In this time I can't apply for my extension without employer's support. Now I would like to understand whether RAV will support me to extend my work permit during my Job search - i mean after 30th of April. Could someone explain how this works.

I am Non- EU person(Indian nationality) and having additional risk that I can't fly back to my country as my wife is pregnant. I have got the letter from the doctor which says that my wife is not recommended to travel due to complications in her pregnancy. So I am looking for suggestion, advice which could help to fix my problems.

Note: I have contributed to AVS/AHV more than 12 months.

The RAV effectively becomes your employer for as long as you qualify for unemployment benefits, and will handle the permit extension(s).

Note however that this does not apply to L and time-limited (project-related) B permits.

Thank you Shorrick,

Regarding the limitation of permit (B) - in my work contract issued by my current employer was mentioned that "We are offering unlimited duration work contract...". Does it helps me.

What matters is what your permit says. If it doesn't carry a "non-extendable past date xx.xx.xxxx" then you should be fine.

Immigration office in berninaplatz ( near Oerlikon ) will say you whether your permit is limited/controlled or not.

Which in turn provides you information abt claim for unemployment benefit.

Non-EU B permit here - just went through this myself.

I made the standard annual renewal application, indicating on the form that I'm unemployed. The Zürich Kantonal Migrationsamt wrote to me asking:

1. When I became unemployed
2. Reason for unemployment (eg resigned, fired, redundant, etc)
3. Whether I have any job offers
4. How I'm supporting myself (eg ALK payments)
5. Period of eligibility for ALK support

I replied with supporting documents and the Migrationsamt replied that my permit would be approved for another year, roughly the period during which I'm still eligible for benefits. If I haven't found a job by then I will have to leave the country.

Thanks for the info. May I know what kind of B- permit you have. Because mine says its bounded to current employee.

Also can u explain what's stands for ALK.

Mine was originally for 36 months maximum but was converted to "open", although my permit still has my employer's name on it.

ALK is Arbeitslosenkasse - they are responsible for payment of unemployment benefits.

Was it difficult for your employer to convert your original 36 months permit to open one ? when did it happened?

it was in 2004 and it was handled by the company's lawyers, but i don't think it was difficult.

RAV support in Extending Non-EU B Permit

Dear friends,

I have been in Life science area and lost my job (R&D-Biotech), due to recession on March 2010. I am being supported by RAV / ALK and I am receiving my unemployment benefits. Meanwhile my B-Permit would expire on July end. I have got application to apply for extension. I had applied (without employment contract) saying that I am searching for Jobs. Now I got a letter from Zivilrecht, informing that they are denying my extension application. They wrote me that my B permit is tied with my employer.

During my First meeting at RAV the councillor told me that my extension would not be a problem. Now I am not sure how to proceed.

I need your suggestion folks.


1. Would RAV helps with my extension ?
2. Should I personally request at Zivilrecht ?

Sorry If this has been discussed already, please direct me.

It doesn't sound good, especially if you're non-EU. The RAV are patchy with info on permits, so best if you go to the Kreisbüro and plead your case. Good luck.

Sounds awesome Shorrik, however I get the feeling that Migration does its thing depending on their mood...

I am receiving RAV, called migration to ask if I could ask for an extension since I had your comments (or Richard´s) about RAV becoming your employer and backed up by the next from the FOM page

So as I start to expose my case (before I mention RAV) she quickly says that I should have left on my first day of unemployment furthermore she says that I am not allowed to get "money from government" and that she would prolly send me a letter...

Without going into much detail I asked If I could stay a couple weeks past my expiration date to leave my apartment and she said she would ask her boss. (expire in Jan and I leave a week after)

Today she calls and says that I CAN, that I have to send her a letter and apply for an extension that would be rejected, but that she would send me a letter instead (or smth confusing) anyway, she didnt hang up without adding "but you are not allowed to get money from government otherwise you should leave immediately"

That is confusing! and now I feel as if I was doing something wrong, when I didnt at any moment tryed to "cheat" the government, I went to RAV and went to my gemainde after they sent me a letter (Cuz they know that I dont work anymore) not like I was hiding anything. But apparently now, if I dont get money then I can stay until Feb but If I get money I have to leave?

Normally, as far as I know, if it's linked to your employer, you can only stay as long as you work there. But I'd think RAV should be able to tell right from wrong...
