Repayment of relocation costs if contract changes

Hi,

I was wondering if someone might be able to advise on expectations of repaying relocation monies if the contract for employment changes and you decide to leave a company.

The background behind this is that I recently moved here and with such a move was given relocation assistance, lump sum payment, schooling etc etc. all of which are cited in my contract as monies to be paid back pro rata should the employee leave the company within two years. This is itself is fine. However, should the terms of my contract change in that the job I signed up to do no longer exists and they offer me a role I do not want take up so therefore decide to leave. Will I be required to pay the relocation amounts as cited in the contract?

I realise in the current economic environment that any job is better than none. But I have very good options in Basel so would be able to go into a job that I want to do. It is just the fact of having to pay back in excess of 30k that holds me back abit.

Any advice on this is very much welcome.

It is probably best to discuss it with your line manager or your Personnel Department. Be open and honest, say that you need to look at all the options and should you decide to leave the organisation what would be the implications.

No one on the forum I guess can second guess your organisation.

I believe it will have to do with the terms of the employment guidelines -- thus, was the job at the same level as the previous one, or one below? Some companies state that you must accept it one below and/or a certain percentage reduction in pay -- otherwise you would have to resign, thus, reducing your chances of getting out ahead. If it was due to a major reorg, and the company is letting people go, I think your chances are better of getting released from any obligations are better. They are much more social in CH about those things.

It's a tricky one. You might have some chances to get out of the clause I would guess if it were to go to court. However, what you need to think about is if you want to go through that whole process. What you could try of course is to ignore the whole issue and hope they decide to forget about it as well. But still be prepared to pay it if they ask for it.

If you don't accept the new job guess they sack you and the company needs to take this into consideration, including losing the right for you to reimburse the company. Now if you leave that's different buy they are sacking you

I thought (I may be wrong) that as long as a company continues to offer you the same salary, benefits and level of job, they have a right to change your job description ? i.e. change your job ?

If this should be the case, they will rightfully hold you to the 2 years.
