<Pls help> Married in CH but divorcing in U.S.

Hello all,

I have a question but could not find what I am looking for in other websites, so I am posting here. Hopefully someone can help me...


We got married 5+1/2 years ago in Horgen (KantonZH) and my husband is a dual citizen CH/US. We both wanna move to the U.S. and I will have to move with him because if so I get a green card in the States.

I read that a divorce abroad is not recognized in Switzerland. Does that mean that we have to get divorced in the US and we will have to follow US divorce law?

What happens when it comes to splitting money if our Pensionskasse is in CH while we are in US?

My husband's Swiss company is sending him to the U.S. and he will one day return to CH. Me, I probably will never return to CH.

I might not be clear on this, so please correct me if I'm wrong - are you looking for our help in scamming the US immigration system? If you're already planning to divorce, then you shouldn't be using your husband as a ticket into the US.

No, pls dont get me wrong. This is something we are planning together. We are in good terms, we actually had a court date set up but recently canceled when he got the job offer in the US. He did not want me to get stuck in CH alone.

I understand you both. Your marriage is dissolving but you still care for each other's well being, and location does indeed impact well being. I would call the Swiss consulate in the US and explain that although your and your husband are moving together, your relationship is on shaky ground and you would like to know what will happen if you can't make things work in the US. I'm sure you don't need to give your name, and I'm also sure you won't be the first phone call they've received of a similar nature.
