Marriage and residency, which one first?

Hello there,

I am in search of some advice, I am not too sure exactly where to find this advice, I have searched but cannot seem to decipher how to proceed.

I am an Australian currently staying in Germany under a work holiday visa, my partner and child are living in Switzerland and we have intended to marry in early 2013, what I would like to know, is if I need to register in Switzerland before approaching the necessary office regarding marriage? or would it be better to first approach the marriage office and then request to register myself in Switzerland? I am totally confused... It seems like I need to prove my residency here in Switzerland before I would be allowed to marry, but I cannot get residency until I am married???

Any information would be greatly appreciated. Thanks in advance.

My son holds a Swiss Nationality and passport.

As you're Australian you may need to get married in Germany first I think. Then you can get a permit under family reunification. You won't get one on your own as Switzerland has a policy of Swiss nationals and EU citizens first with the rest of the world a long way behind. You might be able to get in as her fiance, but your partner really needs to check with her cantonal/communal officials to see what's allowed as the rules vary from place to place.

Bottom line, your swiss partner should approach their Gemeinde and ask about a fiance visa and marriage procedure. They should be able to get an answer very easily from the Gemeinde, and it should be relatively straightforward.

Thanks for your replies, I guess the best thing to do would as you suggest, head down to the Kreisburo and get the relevant info. Thanks again!
