I don't know if there is any way to check this. Do you know any way?

Zivilstandesamt might be a place to start. Might want to give his soon to be ex wife a call to find out her side of the story.

Personally this guy reeks of pond scum. Move on before he wastes anymore of your time.

Does gay partnership also take an approx of 7 months for the divorce procedure just like the heteros?

Re: How to get divorce in Switzerland

Hi Xena,

seems to me that you almost don't know each other ... in any case, because I also married a woman I almost didnt know and I'm currently divorcing here some tips&tricks ...

if they entered into "trennung" or separation, it takes 2 years for the separation to be complete. Then the parties can apply for divorce... in general 2 years and the half are enough ....

Then if he applied directly for divorce and no separation, clearly there are several cases: both agree, only one party agree.

In case of complete agreement (almost impossible to achieve) it may take up to 4 months ... 2 months for the court trial and 2 months of re-thinking for the divorced couple (they might come back togheter) ...

This agreement almost never happens so quickly cause apart some emotional involvement there are financial issues. Does you man have an house of his own property? Do they have common bank account etc... Finally ... do they have children?? Does the wife know about you?? If the court knows he is cheating it may speed up the procedure of divorce and there are no major problems (apart the wife that will ask much more money and probably will get it)

Re: How to get divorce in Switzerland

Yeahh I posted this link to frankwolfe when he was asking questions about divorce because nobody else had answered him and this thread had a little info in it..
So I think that resulted in it being bumped up which could be confusing

But yes.. it is frank (a few posts above me) with the questions now!!

Actually *edit* I just read TravelingMerchants post, and whether Xena still needs the info or not I dont think it matters that much - all the divorce info on here are all asked or told by people with specific circumstances so everyone just answers their specific questions, but now whenever someone new asks about divorce everyone just tells them to check whats already there.. but there really isnt much. I think TravelingMerchants post is helpful and may be useful to someone who is told "search divorce, theres heaps of information there" in the future

Hi Irinchka,

I didn't read the date ... in general if posts are old or outdated should be closed ... if a post is still open means they might still be actual so worth to be answered.

Re: How to get divorce in Switzerland

Hi Merchant,

Thank you for feedback on my questions.
Yes, my man has an house but this house is registered on behalf of of the name of my man and his ex-wife. They have also a common bank account.
As I know they do not have children at least this is what my man has said to me.

Regards,

Xena

Does you man have an house of his own property? Do they have common bank account etc... Finally ... do they have children?? Does the wife know about you?? Re: How to get divorce in Switzerland

Hey, are you still waiting for him after 2 years?? Hope it is real love!!

Well that's amazing ...so this post was not out of date at all ... despite the comments I got ....

Ok, clearly the setup you described me will make things pretty much difficult ... the easy way, to sell the house and divide the money will probably not work ... maybe she wants to stay in the house but she doesn't want to pay the half (here in Switzerland by default you get the common sharing regarding properties and so on, that means that everything you buy during the marriage is 50-50 ... as long as you don't agree differently ) ...

Does she knows about you? In case yes this will make things more difficult for him, cause she will want revenge ... probably she is delaying everything cause she knows about you and your willing to get married ... try to convince her that you both broke up ... maybe it will help!
