How to get divorce in Switzerland

Hello,

My name is Xena. I have just joined the English Forum. Actually, I have not been searching to find this web site. While I was going through the internet, I saw this web site and I decided to get a user ID and password as it was interested to me.

I have a question. Is there anyone who can answer to my question?
I have been in a relationship with a Swiss man for about 4 years. We had really nice times together during this time. Last year, I had bad bays. Because, I have learnt that this guy is married with another women. When I talked him, he said that he started the divorcing process 3 years ago and will get divorce in March or April 2008.

I have friends in Switzerland. I also asked this matter to them. One of them said that, if the couples do not have children and if they agree, it should not be taken too much time to get divorce. It takes 2 weeks or maximum a month. I am now confused again. I don't know if my boyfriend is telling me lie.

Does anybody know how the divorcing process is going in Switzerland?

I would be appreciated if you could reply to me.

There is no such thing as a quick divorce here. First, you have to file. 1 or 2 months later, you will get a set court date, which will be about 3 months later. So already, 5 months have gone by. Then after your court date, you have to wait two months before signing papers to finalize the divorce. So a minimum of 7 months, more like 9 - 12 months is realistic. This is assuming that both husband and wife have agreed how to split things up ahead of time and have a written and signed contract stating this. If the parties decide to fight over property of any type, then it can easily last longer, much longer if children are involved. A friend of mine spent 3 years getting divorced. I don't know what is typical, I can't give you an average of how many months or years and I can't tell you if your boyfriend is telling the truth, but I hope this info helps you.

I would really think twice about this gent. 4 years together and you're only now finding out that he is married? Wonder what else he is hiding from you.

Anyways separation is 2 years, but can be shorter if both parties agree. Time between filing for divorce and appearing before a judge is roughly 4 to 6 months (depending on holidays). In my case I saw the judge once, a month later received the ruling that the divorce is final and then it's a 30 day wait (swiss law) for it to be finalized.

you might find that his second marriage is not valid and he's also liable to be prosecuted for bigamy.

I would like to thank you for your message.

May I learn one more thing if possible? My boyfriend told me that if he did start the divorcing process now or months ago, he would have got divorced quickly due to the new law in Switzerland. Because he started it 3 years ago, the new law does not cover his submittion. Is there a new law regarding divorcing process in Switzerland?

Like I said, there is no quick divorce here. I know this from recent, firsthand experience. The quickest one can hope for is about 7 months, which is quicker than it used to be.

and like everyone is thinking.....what else is he lying about and is your marriage valid?

I'd test this by calling the police and asking what the punishment is for bigamy.

No, I am not married to him. We have been in a relationship for about 4 years. Our plan is to get married in next year. If he gots divorced in this year of course.

It's none of my buiness, but you posted the info here...

I think you mean 'a marriage to your boyfriend' not 'my marriage', as you cannot be married to your Swiss boyfriend.

Anyway, my point is that if you are waiting for the results of his until-now-hidden marriage to see if you stay with him or not, this is no foundation for a relationship.

You have been blatantly deceived over a fundamental basis of your relationship. He should have told you of his marital status within the first few days of meeting not 4 years down the line. Relationships are based on trust - as I see it you have none...

Although this is a bi-national website the rules on separation and divorce apply to everyone (including Swiss). It seems if the divorce is contested things can take much longer. So no two cases are the same and so the any time scale of obtaining a divorce will reflect that. So until you know the facts such as, does his wife contest it? Then it seems hard to work out if three years is too long.

At the beginning of our relationship, he told me that he is not married. But we went to somewhere in Turkey for our summer holiday and there I told him that I do not want to be in a relationship just for fun. He did not say anything to me at that moment and accordingly I thought that he is hidding something from me. I forced him to tell me the truth and later he started to tell something about himself. He said, he started the divorcing process 3 years ago and in March & April 2008, he will officially be divorced.

As he said, he doesn't have children.
