Canceling Mutal agreed divorce [Can't pay divorce settlement]

Hello expert,
We had mutal agreed divorce and according to that I need to pay CHF10,000
before certain date. But, I don't have job and cannot pay that amount plus I have bills to pay and survive. Can the payment be delayed ?

Is that means that the mutal divorce is cancelled and we have to start the divorce again?

If the divorce is through the court and you have the official document, then it is final. You are now not just an Ex, but also a bad debtor: you need to find an agreement with your Ex. The 10K is just an unpaid bill now, He/She can go to the Betreibungsamt about it. This is not something you want to see happen. They can garnishee whatever income/Pension you have, sieze and auction your assets etc.

How did you allow it to happen where you have to pay 10k with no means to do so and no payment plan?

The OP should go back to Court and ask for a re-payment plan. This should have been done at the divorce - crap lawyers!

Ask this kind of question where payment was decided on - at the court or your lawyer's office.
