Need help [concerned about possible malpractice]

Please have some time to read this because we need your help in this matter.

My husband undergone a Laparoscopic surgery in Baden University hospital on April 2015 for his continuous stomach pain and diarrhea. During the surgery they cut appendicitis and also (lymph)adhesion between the colon and stomach wall.

After the surgery pain becomes worst and not bearable. He was not able to urinate, not able to sit or walk normally. Meanwhile he lost his job in November 2015 because of his health. We went again to doctor in Baden but he was not interested in seeing us and told to wait some more days for pain to go off.

We thought of taking second opinion and went to Zurich University hospital. My husband undergone MRI and also Cystoscopy. In this procedure we come to know that one of the nerve named Iliohypogastric nerve has been damaged during the surgery. We continuous went to Pain Management and Urology, there also we didn't get any help and they were just repeating same tablets without understanding his pain.

Till now he is not recovered and continuously having pain followed by other severe problem like urination, muscle cramping, back pain etc. At present we are in Germany as I got some job.

As we are non-EU people , we want to know where we can go and complain about the issue and also get some help. I thought of sharing this to everyone because no one should undergo this kind of situation ever in there life. Please suggest us what to do next.

It certainly looks like your husband needs some further expert opinions.

My health insurance is with Visana, and included in the policy is free insurance against medical malpractice, maybe your insurance has this cover as well?

Thank you for the quick reply.

But we have Assura insurance when we were in Switzerland and I do not think that it has this special feature.

We were in Switzerland until November 2016 and as you know its very difficult without a job to stay. So we moved to Tubingen, Germany.

Here we are with AOK health insurance. He also started his medication here in Tubingen.

Is there any way to get some help from Switzerland due to this medical malpractice.

There is an Ombudsman for health insurance, but I don't think you have an insurance problem, https://www.om-kv.ch/

Your complaint is with the Baden University Hospital, have you contacted their management, and asked for help in repairing the damage?
I can only find a Kantonalspital in Baden....

Otherwise, I suggest you visit a lawyer in Baden and ask him to help you get these difficulties reversed.

This has nothing at all to do with health insurance!

This is 'malpractice' of the doctor, perhaps a surgical error or whatever one calls this properly. For this you should seek help from

SCHWEIZERISCHE PATIENTENORGANSATION, as I presume you are not a member it'll cost you 2.90CHF per minute on the phone with them.

They will advise you what further action to take. They will tell you more adresses of where you could turn to, as well as tell you what the next step to take will be.

Thank you very much for the information.

My husband is still suffering from the pain. Even with meds (OPIDs) and pain coping techniques pain and exhaustion are there 24/7 in varying degrees.

Since last year we have good GP and urologist in Tubingen, Germany. After seeing all his reports, urologist sent my husband for the urodynamic test in the university hospital. In the report, it came out that my husband cannot void the bladder completely (residual urine > 125 ml). They recommend inserting neuro-simulator for the functioning of the urinary tract. They placed two pacemakers and now the residual urine is less than 10 ml.

Our urologist told that this is a functional disability occurred due to surgery in 2015. And there is no solution for the pain. The urinary tract problem normally occurs with the age > 60 (not happens at the age of 34).

My husband has visited the specialist in Zurich hospital and Baden hospital for nearly two years. The specialist from the pain management and urologist won't find an answer for the pain and urinary problems. They informed us that no further treatment is required. They are told him that he has a depression. Because of these assessments, we have not received any compensation from the SVA Argau. My husband almost lost the hope in rebuild his life.

My husband trying hard to get some funding to continue his research and now with the presence of the pacemakers, he cannot able to work in his domain (magnetic field and radiation area). He is hardly getting help to restart his career.

Since 2017 we reside in Germany. Please let me know, how we can take the legal support.

or it is waste of time to fight against it.

As long as we are in Germany, the medical treatments are manageable but it is totally difficult in our country (India).

Please send me the contact details of a lawyer, who has better knowledge of medical-legal things. We need to take the suggestions as the legal fees are also costly.
