What do I do if my ex wife is denying me visitation with my son.

Hi. Does anyone know who I can contact if my ex wife is denying me contact with my son, in canton Zürich? We have a divorce agreement which states I am to see him twice a month but she is not letting me see him. It has been a month. Thanks.

That is what I thought. Was wondering if there were some office that enforces court agreements or something. Thanks.

Go see a lawyer.

(Another user probably posted the same thing already, but who cares, apparently reposting the same information is all the rage this month)

Re: What do I do if my ex wife is denying me visitation with my son.

As OP stated, there was a court already, and the court has made a decision. Enforcing court's decision doesn't necessarily needs yet another lawyer.
Call Einwohnerkontrolle in the Gemeinde where you live, or where your ex lives, tell them your ex doesn't follow the court's decision, they may give you some other advice. Ombudsman? Mediator?

You could start by trying to write a non confrontational letter to her pointing out that the terms of the divorce agreement are legally binding.

That is probably what the lawyer would start off with.

Its not a joke.

Go to a lawyer - the lawyer will submit the right paperwork to the court - the court will look upon the original order - concur it hasn't been kept to - and find in your favor. And then enforce it.

(It might take longer than you hoped but it is far better to get the balls rolling now than in a couple of months.)

Re: What do I do if my ex wife is denying me visitation with my son.

A lawyer is going to cost money. Try contacting the court where the visitation order was made and advise that their order is being ignored.

I would advise, through bitter experience, that this can be a long, heart-breaking and quite possible ultimately fruitless exercise. The biggest danger that your ex puts your child between you and her and tells your child only her side of things.

This matter is better attempted sooner rather than later...

Re: What do I do if my ex wife is denying me visitation with my son.

I have a friend who was in a similar situation a few years back.

The police won't do anything without a judge ordering it, so as already advised, you need to contact your lawyer to ask the court to apply the order.

Even then, every decision the judge makes will be done taking the best interest of your kids first. In my friend's case (false) accusations were made and these had to be investigated first, which can take time.

In my friend's case, the court pressed both parents to try and resolve their issues via family arbitration. Maybe you can call the KESB first for their advice?

Good luck!

Really don't have much money right now 'cause I don't make a lot and the Swiss taxes decided to take a big bite out of me. Working seven days a week, split shifts so time is also a premium. Thanks for the input.

+1

Zero need for OP to waste any amount of money. The agency linked to covers Winterthur though, chances are OP is to contact another one, though they would certainly forward him to the approproate agency.

The first step(s) however should be to get solid evidence. That would involve include written stuff, such letters, emails, etc., and/or a witness or two confirmung OP's ex doesn't answer the door when he's there to pick up the child, etc.

As mentioned above by curley and Urs Max, contacting KESB should probably be the next step. Canton Bern has the following useful information on its website (translated):

Visitation Rights:

"There may be conflicts or problems in connection with the exercise of the right of visitation by ... divorced ... parents. In this case, KESB may admonish or issue instructions to the parents or the child. It may also appoint an assistant to supervise the exercise of the right of visitation."
