maternity and unemployement benefits for grenzgänger

Hello all,

I have been searching the forums and could not find the information to understand my situation, therefore I have taken to the keyboard. First time writer, long time reader.

My wife is pregnant and we are very happy. We have the following scenario:
She is a teacher and is a grenzgänger
The school would like to end her contract next school year but haven't given notice yet but it's clear it will happen
Contract is open ended

As far as I understand it:
She will receive maternity for 14 weeks from Switzerland
She can apply for the German Elterngeld
She cannot have her contract terminated until 14weeks after birth
standard notice period applies on the contract

What happens about unemployment insurance. Is she allowed the 3 months unemployment payments living in Germany?

It would be nice to obtain the unemployment payments even if it's only for 3 months. Can it be delay till after the Elterngeld or do we delay the Elterngeld payment till the end of the unemployment insurance?

Do we have to go through the RAV or the german equivalent for unemployment insurance? Do we have to put the child into day care to collect the unemployment insurance?

I appreciate this is a difficult one but will appreciate any help.

Re: maternity and unemployement benefits for grenzgänger

A cross-border employee who works in Switzerland and becomes unemployed is covered by the unemployed insurance fund in the country of residence, i.e., Germany, but the job-seeker can still register with the Swiss RAV job service. ch.ch says this:

"You are a cross-border commuter If you live abroad and have a cross-border commuter permit (permit G) which allows you to work in Switzerland, you pay contributions in Switzerland. If you have to work short-time you receive compensation under the Swiss unemployment insurance scheme. If you lose your job you receive unemployment benefit in your country of residence but can benefit from the services of the public work placement scheme in Switzerland. In order to do this, contact the job centre in the region where you last worked."

This link provides information on maternity for German cross-border employees working in Switzerland, specifically regarding employment termination (German):

Yes, she has a B permit

Thank you for your message. This clears up a few things in my mind.
